V. Sample Results: Sample results in Attachment A show Copper at 39800 mg/kg and Nickel at 53200 mg/kg levels in sample (Delta P1). Sample (Delta P2) had Copper levels of 4920 mg/kg for Copper, and 4240 mg/kg for Nickel, both above hazardous waste levels for Total Threshold Limit Concentration (TTLC) of Copper at 2,500 mg/kg and Nickel at 2000 mg/kg. Sample (Delta P3), solid waste in the holding tank had Copper levels of 14900 mg/Kg, Lead at 5960 mg/Kg, and Copper at 2680 mg/Kg, which are all above hazardous waste levels. VI. Violations: 1. California Health and Safety Code (HSC), section 25189.2 (c), illegal disposal: Delta Plating violated HSC, section 25189.2 (c), in that on or about May 6, 2003, Delta Plating is not manifesting hazardous waste cloth, sample (Delta P1) and red rouge, sample (Delta P2) to an appropriate facility authorized to accept hazardous waste. Delta Plating showed no documentation of proper disposal and had not made a waste determination. 2. California Code of Regulations (CCR), Title 22, section 66262.11, waste determination: Delta Plating violated CCR, Title 22, section 66262.11, in that Delta Plating failed to make a hazardous waste determination for the cloth material in the trash can and the red rouge on the wall that was sampled. 3. California Code of Regulations (CCR), Title 22, section 66262.34, accumulation time: Delta Plating violated CCR, Title 22, section 66262.34, in that Delta Plating failed to remove hazardous waste from the holding tank that had been onsite waiting for treatment. Bernabe Aquino stated that the waste in the holding tank had been there for a long time waiting for treatment. VII. Conclusion: Delta Plating must handle any waste cloth from buffing operations and red rouge as a hazardous waste, using manifests and a registered hauler. VIII. Attachments: A. Sample results.
