REPRODUCED AT GOVERNMENi EXPENSE <br />41 <br />(d) Employer's liability coverage: $100,000, except in States where <br />workers compensation may not be written by private carriers <br />(e) Others as required by State law. <br />1.10.2 Insurance --Work on a Government Installation (APR 1984): <br />(a) The Contractor shall, at its own expense, provide and maintain during <br />the entire performance period of this contract at least the kinds and minimum <br />amounts of insurance required in the Schedule or elsewhere in the contract. <br />(b) Before commencing work under this contract, the Contractor shall <br />certify to the Contracting Officer in writing that the required insurance has <br />been obtained. The policies evidencing required insurance shall contain <br />an endorsement to the effect that any cancellation or any material change <br />adversely affecting the Government's interest shall not be effective (1) for <br />such period as the laws of the State in which this contract is to be per- <br />formed prescribe or (2) until 30 days after the insurer or the Contractor <br />gives written notice thereof to the Contracting Officer whichever period is <br />longer. <br />(c) The Contractor agrees to insert the substance of this clause, <br />including this paragraph (c), in subcontracts under this contract that <br />require work on a Government installation and shall require subcontractors <br />to provide and maintain the insurance required in the Schedule or elsewhere <br />in the contract. <br />At least 5 days before entry of such subcontractor's personnel on the <br />Government installation, the Contractor shall furnish (or ensure that there <br />has been furnished) to the Contracting Officer a current certificate of <br />insurance, meeting the requirements of paragraph (b) above, for each such <br />subcontractor. (FAR 52.228-5) <br />1.11 NO WAIVER BY THE GOVERNMENT: The failure of the Government in any one <br />or more instances to insist upon strict performance to any of the terms of <br />this contract or to exercise any option herein conferred shall not be <br />construed as a waiver or relinquishment to any extent of the right to assert <br />or rely upon such terms or option on any future occasion. <br />1.12 PAYMENTS TO THE CONTRACTOR: Payments shall be made upon completion and <br />acceptance of individual delivery orders. Submission of payment requests by <br />the Contractor will be subject to reduction for overpayments or increase for <br />underpayments on preceding payments to the Contractor. <br />1.12.1 Payment for Materials Offsite: Pursuant to the paragraph entitled <br />"Payments to the Contractor," payments may be made to the Contractor for <br />materials stored off construction sites.
