REPRODUCED AT GOVERNMENi EXPENSE 41 (d) Employer's liability coverage: $100,000, except in States where workers compensation may not be written by private carriers (e) Others as required by State law. 1.10.2 Insurance --Work on a Government Installation (APR 1984): (a) The Contractor shall, at its own expense, provide and maintain during the entire performance period of this contract at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract. (b) Before commencing work under this contract, the Contractor shall certify to the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be per- formed prescribe or (2) until 30 days after the insurer or the Contractor gives written notice thereof to the Contracting Officer whichever period is longer. (c) The Contractor agrees to insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. At least 5 days before entry of such subcontractor's personnel on the Government installation, the Contractor shall furnish (or ensure that there has been furnished) to the Contracting Officer a current certificate of insurance, meeting the requirements of paragraph (b) above, for each such subcontractor. (FAR 52.228-5) 1.11 NO WAIVER BY THE GOVERNMENT: The failure of the Government in any one or more instances to insist upon strict performance to any of the terms of this contract or to exercise any option herein conferred shall not be construed as a waiver or relinquishment to any extent of the right to assert or rely upon such terms or option on any future occasion. 1.12 PAYMENTS TO THE CONTRACTOR: Payments shall be made upon completion and acceptance of individual delivery orders. Submission of payment requests by the Contractor will be subject to reduction for overpayments or increase for underpayments on preceding payments to the Contractor. 1.12.1 Payment for Materials Offsite: Pursuant to the paragraph entitled "Payments to the Contractor," payments may be made to the Contractor for materials stored off construction sites.
