Z A chronic violation or a violation that is committed by a recalcitrant violator. In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). On January 23,2017,Elena Manzo of the San Joaquin County Environmental Health Department(EHD)performed a routine underground storage tank inspection at the above referenced site.An inspection report was issued identifying information to be submitted to bring this site into compliance.This information was required to be submitted 30 days after receiving the inspection report.This information has not been received resulting in a non- compliant status for this facility. The outstanding violations include but are not limited to the following: -Failed to test spill containers annually. Annual spill container testing was last performed on 1/29/16.(HSC 25284.2) -The diesel leak detector failed to detect a leak when tested. All line leak detectors shall be capable of detecting a 3 gallon per hour leak at 10 psi.(CCR 2636(f) (2)) -The L18 UDC 3/4 sensor failed to activate an audible and visual alarm when tested to ensure continuous monitoring.(CCR 2636(f)(1)) -The communication inside UDC 1/2 and 3/4 failed when tested. The 87 sump communication could not be tested due to a missing brine test port. The system shall be designed and constructed with a continuous monitoring system capable of detecting the entry of liquid or vapor from primary containment into secondary containment. (HSC25290.1(e)) Additional issues include: -The current financial responsibility documents have not been submitted into the California Environmental Reporting System(CERS) website. Current financial responsibility documents are required to be submitted annually. Immediately log into the CERS website at http://r-ers.calepa.ca.gov and upload the required documents(HSC 25292.2) The site must be brought into compliance to avoid the entire UST system being red tagged 7-days from the receipt of this Notice.
