<br />1. Thirty Year GeoFlex' System Warranty
<br />(55*7-01OG
<br />Environ Products, Inc. ("Seller") warrants that products sold by it which are incorporated into its GeoFlexeSystem, as herein
<br />defined, shall be of good materials and workmanship and free from functional defects for a period of thirty (30) years from date of
<br />sale, excepting valves and fittings and products containing electrical components, which.^halâ–º be of good materials and
<br />workmanship and free from functional defects for a period of one (1) year from date of sal;. Seller further warrants that such
<br />products used in their intended applications shall be compatible with gasoline, gasohol, etharol, rrethanol, kerosene, jet "A",
<br />aviation fuel, diesel fuel and motor oil.
<br />The GeoFlex® System shall consist of the GeoFlexe piping, with or without GeoDuct'" piping, installed together with Seller's
<br />dispenser sumps, tank sumps, entry boots and sump mounting adapters, together with third party approved tank and dispenser
<br />sump leak detection sensor.
<br />This Limited Warranty shall be null and void if the products to which it applies: (a) are employed in above ground applications, (b)
<br />have been installed by anyone other than an installer trained by Seller, or in a manner which fails to conform to the Seller's written
<br />installation instructions, (c) have been installed without a third party approved leak detection device located in each tank and dispenser sump,
<br />(d) have been installed in sites where the backfill is contaminated with any petroleum product, (e) have been installed in sites where any
<br />associated underground storage tanks have not been properly anchored, or (f) have been installed with another manufacturer's dispenser
<br />sumps, tank sumps. entry boots or sump mounting adapters.
<br />11. Ten Year Product Warranty
<br />Sellerwarrants that it's GeoFlex' and GeoDuct'" piping, dispenser sumps, tank sumps, entry boon and sump mounting adapters shall
<br />be of good materials and workmanship and free from functional defects for a period of ten (10) years from the date of sale. Seller
<br />further warrants that all products shall be compatible with gasoline, gasohol, ethanol, methanol, kerosene, jet "A", aviation fuel,
<br />diesel fuel and motor oil.
<br />This Limited Warranty shall be null and void if the products to which it applies: (a) are employed in above ground applications, (b)
<br />have been installed by anyone other than an installer trained by Seller, or in a manner which fails to conform to the Seller's
<br />written installation instructions, (c) have been installed without a third party approved leak detection devi.e located in each tank and
<br />dispenser sump, (d) have been installed in sites where the backfill is contaminated with any petroleum product, (e) have been installed in sites
<br />where any associated underground storage tanks have not been properly anchored, or (e) respecting Seller's piping products, some
<br />manufacture's tank and dispenser containers have not also been contemporaneously installed.
<br />111. One Year Product Warranty
<br />The Seller warrants that it's valves and fittings, manhole cover, overspill containers, installer tools and all products which contain
<br />electrical components, shall be of good materials and workmanship and free from functional defects for a period of one (1) year from
<br />the date of sale.
<br />This Limited Warranty shall be null and void if the products to which it applies: (a) have been installed or employed by anyone other
<br />than an installer trained by Seller, or in a manner which fails to comply to the Seller's wrir:en installation instructions, or (b)
<br />respecting Seller's coupling machine, if another manufacturer's couplings have been employed.
<br />AS THE EXCLUSIVE REMEDY FOR ANY BREACH OF THE ABOVE LIMITED WARRANTIES, SELLER WILL REPLACE NONCONFORMING
<br />GOODS OR REFUND THE PURCHASE PRICE. THESE LIMITED WARRANTIES ARE IN LIEU OF ALL OTHER VJARRAKTIES, EXPRESS OR
<br />IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE CONCERNING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
<br />THESE LIMITED WARRANTIES ARE ALSO IN LIEU OF ANY OTHER POSSIBLE LIABILITIES OF SELLER WHETHER ALLEGED TO ARiSE BY
<br />AGREEMENT OR BY OPERATION OF LAW, RESPECTING THE SALE, INSTALLATION, USE OR FUNCTION OF SELLER'S PRODUCTS,
<br />INCLUDING BUT NOT LIMITED TO CLAIMS OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY OR ANY OTHER TORT. IN NO EVENT
<br />SHALL SELLER BE LIABLE FOR PERSONAL INJURY OR PROPERTY DAMAGE, REAL OR PERSONAL, ATTRIBUTED TO iT'S PRODUCT, NOR
<br />FOR ANY EXCAVATION, REMOVAL, DOWNTIME, CLEANUP, LOSS OF USE, LOSS OF OPPORTUNITY, LOSS OF MAR<:'T VALUE, LOSS OF
<br />RENTAL VALUE OR FOR ANY LOSS OF PROFITS OR OTHER SPECIAL, INCIDENTAL, RESULTING, CONSEQUENTIAL OR EXEMPLARY
<br />DAMAGES.
<br />No person is authorized by Seller to assume for it any other liability of any kind in connection with the sale or use of products
<br />manufactured and sold by it, and there are no oral agreements or warranties collateral to or affecting any sale or use. All of the
<br />foregoing arises under the substantive law of Pennsylvania without regard to principles of conflicts of laws.
