EHD staff, during <br />site visits on February 11, February 12, and February 14, 2008, verified the business to be closed. At this <br />time, the EHD is unable to determine if the underground storage tank (UST) system is continuing to be <br />monitored in accordance with applicable laws and regulation. <br />According to Fidelity National Title Company, the escrow transferring the business assets at this site to you <br />was closed on January 25, 2008. As of this date, the EHD has not received an application to operate the <br />UST system at this site. <br />On January 25, 2008, invoices were mailed out for the 2008 UST operating permit fees as well as other <br />associated fees. As of this date, the EHD has not received payment for these fees. <br />Violation: <br />California Health and Safety Code, Section 25298 (b) - Abandonment, closing or temporary ceasing of <br />operation of underground storage tank. <br />This section states that an USTsystem that is temporarily taken out of service, but which the owrier or <br />operator intends to return to use, shall continue to be subject to all the permit, inspection, and monitoring <br />requirements of the chapter unless a temporary closure permit application is obtained. Monitoring of the <br />UST Facility must continue to be conducted daily by inspecting the monitoring panel for alarms. Records <br />need to be kept documenting this activity. <br />Corrective Action: <br />Immediately, maintain oversight and control of the continuous monitoring of the UST system at this <br />site, either by onsite personnel or by a remote monitoring system. The UST system at this site must <br />be continuously monitored at all times in accordance with the law until such time that the UST <br />system is subject to temporary closure or tank removal conducted under an approved permit issued <br />from EHD. <br />
