A permit to repair/replace the spill buckets was issued <br /> by EHD on 12/4/07 and expired on 3/4/08. Failure to repair/replace the 91 and diesel spill buckets <br /> is a continuing violation of CCR2635(b)(1), <br /> Violation: CCR2635(b)(1)—All UST shall be equipped with a spill container and an overfill <br /> prevention system as follow: (1)the spill container shall collect any hazardous substances spilled <br /> during product delivery operations to prevent the hazardous substances from entering the <br /> subsurface environment. <br /> Corrective Action: Immediately, discontinue deposition of petroleum into this tank until the <br /> component is repaired/replaced by a properly licensed,trained, and certified contractor under <br /> permit by the San Joaquin County Environmental Health Department. <br /> Please be advised that failure to repair or replace the 91 and diesel spill bucket is a continuing <br /> violation of California Health& Safety Code Section 25299.3(b),Any owner of an underground <br /> tank system shall be liable for a civil penalty of not less than five hundred dollars($500)or more <br /> than five thousand dollars($5,000)per day for each underground storage tank, for each day of <br /> violation, for any of the following reasons: (2)Failure to repair or upgrade an underground tank <br /> system in accordance with this chapter. <br /> If you have any further questions, please contact me at(209) 468-3453, fax to (209)468- <br /> 3433 or email to acacapit@sjcehd.com. <br /> Thank you, <br /> AW L-L <br /> Aris Cacapit, EHS <br /> Environmental Health Specialist <br />
