Unit: 31258 nocal # : 6981 <br />t_essee"lame : James McCarthy <br />Address : 4707 Pacific <br />Stockto , CA 95207 <br />UNDE GROUND STORAGE TANKS (UST) OWNER/OPERATOR AGREEMENT <br />California Underground Storage Tank Regulations (CCR, Title 23, Division 3, Chapter 16, Article 2, Section 2620(b)) require Tosco <br />Corporation (the tank owner) to execute a written agreement with our Dealers (the tank operators), requiring them to monitor the <br />underground storage tanks (USTs) containing hazardous substances. <br />PART I: OWNER CERTIFICATION <br />Tosco Corporation, as owner of the USTs at the above site, certifies that: <br />1. It is not the tank operator of the USTs at said site. <br />2. It has applied for the UST permit, and a valid UST permit is on-site or will be delivered to the tank operator when received <br />from the local implementing agency. <br />3. A copy of the Health and Safety Code, Section 25299 is attached to this Agreement. <br />4. It will notify the local implementing agency of any operator change within thirty (30) days of any such change. <br />5. Both Tosco Corporation and the operator have signed this Agreement. <br />PART II: OPERATOR CERTIFICATION <br />The law requires the tank operator of USTs containing motor vehicle fuel to comply with the following standards: <br />1. A valid UST permit shall be maintained on site. <br />2. A UST Monitoring Program, approved by the local implementing agency, must be implemented. <br />3. A Spill Response Plan, approved by the local implementing agency, must be implemented. <br />4. The requirements stipulated in the UST Monitoring Program and Spill Response Plan (attached), must be complied with. <br />This shall include, if necessary, the submittal of an annual written statement to the local implementing agency, verifying <br />under penalty of perjury that all monthly monitoring reports were summarized, and that all data contained within the <br />monitoring reporrts are within allowable variations. Alternatively, a listing of the times, dates and corresponding <br />monitoring report data that exceeded the allowable variations must be provided. <br />5. The monitoring and maintenance records must be maintained. This includes inventory readings and reconciliation records, <br />sampling and testing results, all of which must be maintained on-site for at least 3 years, or in an approved off-site location. <br />Said records must be made available upon request, within 36 hours, to the local implementing agency or the State Water <br />Board. <br />6. Records must be kept in sufficient detail to enable the local implementing agency, at any time, to determine that the tank <br />operator has undertaken all monitoring activities required by the UST Permit to Operate and/or the UST Monitoring <br />Program. <br />7. Tosco Corporation must be notified of the detection of any unauthorized releases by the fastest means available (no later <br />than 8 hours) or within the time frame mandated by the local implementing agency. The operator must adhere to the <br />procedures contained in the Spill Response Plan. Tosco Corporation will notify the appropriate agency(s) and submit a <br />written report as may be required by the agency(s). <br />8. Daily inventory measurements must be performed by a trained facility operator or designated facility personnel for each <br />day the facility is in operation. <br />9. Tosco Corporation must be notified of any malfunctioning of the UST monitoring system. The monitoring equipment shall <br />be operated and maintained in accordance with the regulation per Title 23, Division 3, Chapter 16, Article 4, Section <br />26410) of the California Code of Regulation. <br />10.
