Management of Removed Water is a component part of several of the types of services
described herein. For example and without limitation, Contractor may remove from a
tank system infiltrated groundwater or stormwater or other water when providing
Equipment Certification Services, Phase I and Phase II Vapor Recovery System Testing
Services, Secondary Containment Testing Services or Unscheduled Maintenance
Services. Whenever water is thus removed by Contractor from a petroleum storage tank
("PST") system that has some possibility of being contaminated with petroleum or other
contaminants ("Removed Water"), a component part of such Services shall be to comply
with the following procedure.
Classification. Contractor shall determine in the field, using the criteria defined
herein, whether to classify the Removed Water as Non -Hazardous.
a. Contractor shall visually examine the surface of the water to determine
whether it exhibits an oily sheen and whether it exhibits a petroleum odor.
b. The observation may be made wherever it is practicable to do so, e.g.,
either while the water is still in the overfill sump or other sump, or after
removing water into a pail or other container.
c. If the water exhibits no sheen or at most a light sheen and does not exhibit
a distinct petroleum odor, then Contractor shall classify it as Non -
Hazardous.
d. If the water exhibits either more than a light sheen or a distinct petroleum
odor, then Contractor shall classify it as Hazardous.
e. Using these criteria, some Removed Waters thus determined to be
Hazardous nevertheless may not qualify as hazardous waste under
California or federal law, but the criteria herein are intended to be
conservative.
2. Non -Hazardous Water. Contractor generally shall transport water classified as
Non -Hazardous for proper off-site disposal, as outlined below.
a. Whenever practicable, Contractor shall bring to the AT&T facility a
container with capacity sufficient to hold the quantity of Non -Hazardous
water that is reasonably expected to be generated by the services that
Contractor expects to provide there. This may be for example a trailer -
mounted tank or smaller tank mounted on the Contractor's truck.
b. Whenever practicable, before leaving the AT&T facility Contractor shall
transfer to such containers water classified as Non -Hazardous and shall
transport it to a proper disposal facility.
c. If it is necessary for Contractor instead to leave water classified as Non -
Hazardous at the AT&T facility when Contractor finishes its service visit,
Contractor shall leave it in an appropriate closed container labeled as non-
hazardous.
3. Hazardous Water. Contractor shall leave water classified as Hazardous at the
AT&T facility in an appropriate closed container with an approved hazardous
waste label.
