In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> The site must be brought into compliance to avoid your entire UST system being red tagged-7-days from the receipt of this notice. <br /> Outstanding violations include but are not limited to the following: <br /> 1.A permit to operate the UST system (all tanks) has not been issued and permit fees have not been paid (HSC 25284). <br /> 2. Failed to submit secondary containment test report within 30 days(CCR 2637(e)). <br /> 3. Failed to submit monitoring system certification test results within 30 days(2638(d)). <br /> 4. Failed to submit the UST Certification of Installation/Modification on CERS for SR0072496 (CCR 2635 (d)). <br /> 5. Failed to submit a written response within 30 days of receiving an inspection report(CCR2712 (f)). <br /> 6. Failure to maintain monitoring, maintenance,and follow up action records(CCR2712(b)). <br /> 7. Current monitoring plan approved by the EHD not found on site (CCR 2712(i)). <br /> 8. Failure to comply with UST operating permit conditions(CCR 2712). <br /> 9. Failure to record an unauthorized release from primary containment observed by the designated operator on <br /> 12/5/2017 and by the EHD on 1/23/2017 (HSC 25294). <br /> 10.
