Item E then
indicates that a U.L. listing is available if required.
Yet, the only U.L. listing I've seen for the product is for an underground application only. Is there another U.L. listing or a lisfing by any other approved third -party listing agency
that qualifies the sump for use above ground or partially buried? This is what we've been asking for. I assume that this is not available. Can you please confirm? Has the
company begun the process to secure such approval?
Under the construction specification clause, it reads that the sump will be unaffected by ultra -violet light exposure and not be weakened by such exposure. This is an appropriate
expectation. However, has the sump ever been tested to meet national standards for that application? It is one thing to claim this and another thing to prove this. As a building
department, we have often seen product literature claiming certain listings where no listings are actually provided. Typically, we read that a certain product meets the ASTM
Standard XXX7878 (for example) only to find that no third -party evaluation was ever done. The manufacturers simply make the claim that it meets the national standard in order
to facilitate the sale of the product.
Lastly, I am hearing that you say the intended use of this product is universally used and accepted in the industry. What jurisdiction has specifically approved it? Do you have
contact information where we could speak with those who have approved it? The installafion of the sump in our City did not go through our permit process and we are currently
working on coordinating efforts between our CIP and building permit processes in order to ensure that the work under a CIP meets related code requirements.
Kevin Jorgensen
Chief Building Official
City of Tracy
333 Civic Center Plaza
Tracy, California 95376
(209)831 -6400 -office
(209)831 -6415 -direct
(209)831 -6439 -fax
k_Qv_in jqrensenack us
From: Mike Robertson[mailto:mike@robertsonengineering.net]
Sent: Tuesday, May 10, 20112:12 PM
To: 'Kasey Fraley [EH]'; 'Thuy Tran [EH]'
Cc: Kevin Jorgensen
Subject: RE: TRACY TRUCK & AUTO
Kevin,
I got your voice message from this morning. Attached is a third party letter from a Mechanical Engineer regarding the use of fiberglass
transition sumps and 2 sheets from the manufacturer showing the UL listed symbol for their transition sumps.
I must ask you how long has the transition sump been in place at the City Corp yard and is there any evidence of UV cracking or failure. I
am not aware of any that I have seen.
Hopefully this satisfies you regarding the product. It is the product used as the standard of care in the industry.
Mike Robertson
ROBERTSON ENGINEERING, inc.
2300 Bethards Drive, Suite L
Santa Rosa, CA 95405
Phone: (707)523.7490
Fax: (707)523.7499
Email: mike@robertsonengineedng.net
From: Kasey Fraley [EH] [mailto:KFoiey@sjcehd.com]
Sent: Tuesday, May 10, 201111:24 AM
To: Mike Robertson; Thuy Tran [EH]
Cc: kevin.jorgensen@d.tracy.ca.us
Subject: RE: TRACY TRUCK & AUTO
Mike,.
I spoke with Kevin and we agree that once we see the UL approval for the UV coating on the sumps we can move forward.
