COTULLA, <br /> IN RE: SITE CODE: 1TS3 <br /> PURSUANT TO YOUR LETTER OF 11 DECEMBER, 1989 AND REMEDIATION PLAN <br /> ALREADY SUBMITTED, I HEREIN SUBMIT ADDITIONAL INFORMATION AS AN ADDENDUM <br /> TO OUR PREVIOUSLY SUBMITTED PROPOSAL REQUESTED BY YOUR DEPARTMENT. <br /> (1) ESTIMATE OF QUANTITY AND COMPOSITION OF THE LIQUID LEAKED (INCLUDING <br /> BASIS OF ESTIMATE) . <br /> AS WAS STATED IN OUR PROPOSAL, BOTH OF THE SUBJECT TANKS WERE USED <br /> SOLELY FOR THE STORAGE OF GASOLINE DURING THEIR LIFE. FURTHER, OVER <br /> THE YEARS, WE NOTED THAT THE VENDORS FILLING THESE TANKS OCCAS1LrkV%LLY <br /> LET A VERY SMALL QUANTITY OF MATERIAL DRIP WHEN FILLING OR DURING THE <br /> SUMMER WHEN THE TANKS WERE FILLED TO THE VERY TOP, EXPANSION LET A <br /> VERY SMALL QUANTITY OF MATERIAL OVERFLOW. BASED ON OUR OBSERVATIONS, <br /> WE ESTIMATE THAT DURING THE LIFE OF THE TANKS IN GROUND, A MAXIMUM <br /> OF TEN (10) GALLONS MAY HAVE LEAKED AROUND THE FILL PIPES. <br /> (2) nt PROPOSED PROGRAM, INCLUDING METHODOLOGY`TO DEFINE THE EXTENT OF <br /> SOIL AND GROUND WATER CONTAMINATION. <br /> SIS WAS PREVIOUSLY STATED IN OUR SUBMITTED PROPOSAL, WE INTEND TO <br /> REEXCAVATE THE CAVITY AND REMOVE AN ADDITIONAL FOUR ('-I') FEET FROM <br /> THE BO-{TOM OF THE PRIOR EXCAVATION. IN'E PROPOSE THAT A CERTIFIED <br /> LABORATORY WILL TAKE TWO (2) SAMPLES FROM THE NEW EXCAVATION AND <br /> TEST FOR THE CONSTITUENTS WHICH HAD SHOWN UP IN THE P,10R TESTING <br /> TO INCLUDE TEST # 8020 AND # 8015. 4E PROPOSE THAT THE TWO (2) <br /> M <br /> Accounts are due and payable on demand. Accounts over 60 days to bear interest at the rate of 1% per month. <br /> Work is guaranteed against defective workmanship for one year. Guarantee applies only if ditch is completely backfilled not <br /> earlier than three days or later than ten days after completion, and in any instance before water is put into pipeline. <br /> "Laid" price includes furnishings, delivery, laying and initial backfill of pipe in owner's properly prepared dry trench. Any <br /> additional materials and labor deemed necessary to complete a workable job and extra material and labor for wet, unstable or <br /> hardpan conditions are to be added and billed at our prevailing rates. <br /> "Trenching" — Ditch dug by machine is for normal conditions. Extra charge will be made for excessive hardpan, unstable condi- <br /> tions or any hard labor found necessary. <br /> In the event that legal action is required to enforce any provision of this agreement, the losing party in said action shall pay <br /> to the successful party reasonable attorney's fees and costs, as determined by any court of competent jurisdiction. <br /> All estimates, quotations, orders and contracts if affected by strikes, labor difficulties, lock-outs, accidents, acts of God, or other <br /> contingencies beyond our control, will be invalid. Time of delivery, performance or quotations will be extended or increased to the <br /> extent necessitated by any of said causes. <br />
