RESCH, IN RE: 381 !"IEST TADDEI ROAD ACAMPO CALIFORNIA 95220 SOIL REMEDIATION PLAN THE TWO GASOLINE FUEL TANKS ON OUR PROPERTY WERE REMOVED ON OCTOBER 51, 1959 IN ACCORDANCE WITH ALL APPLICABLE REGULATIONS, SOIL SAMPLE TEST RESULTS AS PERFORMED BY FGL ENVIRONMENTAL INDICATE THAT VERY 141NOR TRACES OF GASOLINE CONSTITUENTS REMAIN IN THE SOIL UNDER THE TANK BOTTOM AREAS, THIS IS NOT SURPRISING AS THESE TWO FUEL TANKS WERE IN GROUND FOR APPROXIMATELY 15 YEARS. DURING THE COURSE OF THEIR USE, THE COMPANY FILLING THEM FREQUENTLY OVERFILLED THEM SLIGHTLY OR WHEN THEY WERE TOPPED OFF DURING HOT WEATHER, EXPANSION CAUSED A SLIGHT LEAKAGE. THE COPY OF THE ENCLOSED LETTER FROM FALCON ENERGY INDICATES THAT WHEN THE TANKS WERE FILLED WITH WATER FOR TORCHING, AFTER THEY HAD BEEN PROPERLY RINSED, THEY DID NOT LEAK. THE HISTORY OF USE THEREFORE INDICATES THAT SMALL QUANTITIES OF GASOLINE PERMEATED THE SOIL FROM OVERFILLING AND EXPANSION. 11"IE THEREFORE PROPOSE THE FOLLOWING REMEDIATION MEASURES TO INSURE THAT NO CONTAMINATED DIRT REMAINS IN THE EXCAVATION AND A CLEAN CLOSURE IF EFFECTED. (1) REOPEN THE EXCAVATION TO THE HOLE BOTTOM- ( YOU HAD INSTRUCTED US TO' CLOSE THE HOLE WHILE YOU WERE ON SITE) (2) REMOVE AN ADDITIONAL FOUR (4) FEET OF SOIL FROM THE HOLE. (3) OBTAIN AN AERATION PERMIT FROM SAN JOAQUIN COUNTY APCD FOR AERATION OF THE CONT/V-11NATED SOIL ESTIMATED TO BE EIGHT (3) ;'ARDS. Accounts are due and payable on demand. Accounts over 60 days to bear interest at the rate of 1% per month. Work is guaranteed against defective workmanship for one year. Guarantee applies only if ditch is completely backfilled not earlier than three days or later than ten days after completion, and in any instance before water is put into pipeline. "Laid" price includes furnishings, delivery, laying and initial backfill of pipe in owner's properly prepared dry trench. Any additional materials and labor deemed necessary to complete a workable iob and extra material and labor for wet, unstable or hardpan conditions are to be added and billed at our prevailing rates. "Trenching" — Ditch dug by machine is for normal conditions. Extra charge will be made for excessive hardpan, unstable condi- tions or any hard labor found necessary. In the event that legal action is required to enforce any provision of this agreement, the losing party in said action shall pay to the successful party reasonable attorney's fees and costs, as determined by any court of competent jurisdiction. All estimates, quotations, orders and contracts if affected by strikes, labor difficulties, lock-outs, accidents, acts of God, or other contingencies beyond our control, will be invalid. Time of delivery, performance or quotations will be extended or increased to the extent necessitated by any of said causes.
