With respect to your request to decommission the existing remedial systems, PHS/EHD is <br /> not convinced that the goals have been met and remediation can be considered complete. <br /> It is our understanding that data is being collected to support Southland's assumptions as <br /> to the success of cleanup activities to date. <br /> 2. Pursuit of the Connie Avenue monitoring well(s) should continue since there has been no <br /> response from Mr. and Mrs.Rocha and we cannot count on their cooperation in the future. <br /> Please submit a work plan, permit application, and a check for $89.00 for the permit fee <br /> y . HC-4,e. 31 r 1 g 2 { <br /> The underground fuel storage tanks at this site are in violation of Division 20,Charter 6.7, <br /> of the Health and Safety Code,Section 25299,Subsection(b);which states that,'any owner <br /> of an underground tank system shall be liable for a civil penalty of not less than five <br /> hundred dollars ($500) or more than five thousand dollars ($5,000) per day for each <br /> underground storage tank, for each day of violation...' Technically, this system has been <br /> out of compliance for some time, PHS/E D has tolerated the tanks remaining in place to <br /> avoid disturbing the edsting remediation systems.
