Non-dispensable over-the-counter drugs for acts or omissions occurring on <br /> 2 or after one hundred eighty (180) days following receipt by Defendant of written notice as <br /> 3 provided by Paragraph 8 of the People's intent to do so. <br /> 4 The Parties shall attempt to resolve any such dispute by means of good faith informal <br /> 5 negotiations. <br /> 6 5. CIVIL PENALTIES, SUPPLEMENTAL ENVIRONMENTAL PROJECTS, <br /> 7 COSTS,AND ENHANCED ENVIRONMENTAL COMPLIANCE EFFORTS <br /> 8 In consideration of Defendant's efforts to implement a company-wide retail <br /> 9 hazardous/unsalable product waste program and the creation of new, enhanced compliance <br /> 10 programs, as set forth in paragraph 5.3, Defendant shall, in accordance with this Final Judgment, <br /> 11 pay Civil Penalties, fund the Supplemental Enviromnental Projects provided for in this Final <br /> 12 Judgment, and pay costs, in the total amount of TWO MILLION,FIVE HUNDRED AND <br /> 13 FIFTY THOUSAND DOLLARS ($2,550,000.00) Said payments may be made by business or <br /> 14 cashier's check and shall be made as set forth in paragraphs 5.1, 5.2, and 5.4 below, in four equal <br /> 15 installments pursuant to the following schedule: The first payment shall be made no later than <br /> 16 April 1, 2013;the second payment shall be made no later than January 1, 2014; the third payment <br /> 17 shall be made no later than October 1, 2014; and the fourth payment shall be made no later than <br /> 18 July 1, 2015. Defendant shall deliver all required payments to the District Attorney's Office for <br /> 19 the County of San Joaquin, Attention: David J. Irey, Supervising Deputy District Attorney, for <br /> 20 distribution pursuant to the terms of this Final Judgment. <br /> 21 5.1 Civil Penalties <br /> 22 Defendant shall pay TWO MILLION, SEVENTY THOUSAND DOLLARS <br /> 23 ($2,070,000.00) as civil penalties pursuant to Health and Safety Code sections 25189 and 25514, <br /> 24 and Business and Professions Code section 17206,to the prosecuting agencies/regulatory <br /> 25 agencies identified in, and in accordance with the terms of, Exhibits B-1 and B-2, attached. <br /> 26 <br /> 27 <br /> 28 <br /> 9 <br /> STIPULATION FOR ENTRY OF FINAL JUDGMENT AND PERMANENT INJUNCTION <br />
