"Alder Street, " which is one of the proposed road names, is <br /> not acceptable, as "Alder Avenue" already exists in the Tracy <br /> Planning area. <br /> The Planning Division will be recommending approval of this appli- <br /> cation subject to the following Recommended Conditions of Approval: <br /> 1 . Access off of Valpico Road shall be restricted for Lots 1 , <br /> 10 , 15 , and 24 . <br /> 2 . Access off of Chrisman Road shall be be restricted for Lots <br /> 20-24 . <br /> 3 . All street names shall be as approved by the Planning Director. <br /> 4 . The Public Report filed with the State Department of Real <br /> Estate shall be submitted to this office for review and approval <br /> and shall include the following: <br /> a. The payment of Development fees will be required prior <br /> to the issuance of building permits. <br /> b. Indicate the current and possible increased activity at <br /> the Tracy Municipal Airport and the related noise poten- <br /> tial from aircraft in the project area. <br /> C. The County' s right-to-farm ordinance shall be referenced. <br /> 6 . In lieu of conveyance of park land to the County, as prescribed <br /> in Section 9-9261 of the Planning Title, the developer shall <br /> contribute fees of equivalent value as defined in Section <br /> 9-9264 . Arrangements for the payment of said fees shall be <br /> approved by County Counsel prior to final map recordation. <br /> 7 . Pursuant to Section 66474 . 9 of the Subdivision Map Act, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, <br /> or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, <br /> which action is brought within the time provided for in Section <br /> 66499 . 37 of the Subdivision Map Act. <br /> KS: jdh <br />
