The permitted use shall not a.t any time develop into a nuisance, as herein defined. If, in the opinior: of the <br /> Board of Adjustment, Planning Commission or Board of Supervisors, any County Ordinunce or State Low or <br /> regulations or conditions attached hereto are being violated in connection with the operation of this; u:;.:, ttlat <br /> they retain the power to revoke or modify this permit. For the purposes of ;his use permit, a nuisance i:; defined <br /> us follows: <br /> "Nuisance is defined as anything resulting from unreasonable or unlawful practices or from <br /> neglect which is, or tends to be injurious to health, saftey or public welfare, or is unsightly <br /> or offensive to the senses so as to interfere with the comfortable enjoyment of life or property <br /> in the neighborhood area, as such neighborhood area is defined by the Planning Commission <br /> or Board of Adjustment." <br /> 2. The attached Plot Plan is hereby made a permanent part of this approved use permit and shall be identified as <br /> "EXHIBIT A," and all construction, reconstruction, moving, remodeling or other structural alteration shall be <br /> made in conformity therewith. Any variation from said Plot Plan shall be first approved by the Planning Depart- <br /> ment, Commission or Board of Adjustment. <br /> 3. This use permit is granted under the condition that said permit not be transferred within a 90-day period after <br /> the date or approval. <br /> 4. This Use Permit shall expire at the end of one year after the date of approval if construction has riot been <br /> commenced and/or diligently pursued to completion. In addition, this Use Permit ::hall be null and void if the <br /> use(s) permitted are abandoned or unused for one year. <br /> 5. This Use Permit is approved for one year. Applicant may apply for <br /> renewal. Request for renewal would have to be submitted prior <br /> to expiration of this permit. <br /> 6. Local Health District : <br /> a. Obtain discharge requirements from the Regional Water Quality <br /> Control Board, Central Valley Region. Provide minimum five <br /> foot high perimeter fencing around the ponds with a locked <br /> gate. <br /> b. Regulations of Air Pollution Control District: <br /> 1) Scrubber exhaust: Rule 407 , Sulfur Compounds - A person <br /> shall not discharge into the atmosphere sulfur compounds, <br /> which would exist as a liquid or gas at standard conditions, <br /> exceeding in concentration at the point of discharge : <br /> 0.2 percent by volume calculated as sulfur dioxide (SO2) . <br /> 2) Pond and scrubber exhaust: Rule 418, Nuisance - A person <br /> shall not discharge from any source whatsoever such <br /> quantities of air contaminants or other material which <br /> cause injury, detriment, nuisance or annoyance to any <br /> considerable number of persons or to the public or which <br /> endanger the comfort, repose, health, or safety of any <br /> such person or the public or which cause or have a natural <br /> tendency to cause injury or damage to business or property. <br /> 7.
