CONDITIONS OF APPROVAL <br /> All conditions , unless otherwise noted, shall be fulfilled prior <br /> to approval of the final map. <br /> 1 . Planning Division: <br /> a . In lieu of conveyance of park land to the County as <br /> prescribed in Section 9-9261 of the City Code , the deve- <br /> loper shall contribute fees of equivalent value as defined <br /> in Section 9-9264 . Arrangements for the payment of these <br /> fees shall be approved by the City Attorney prior to final <br /> map recordation. <br /> b. The developer shall enter into a Subdivision Agreement <br /> with the City for the purpose of mitigating this project ' s <br /> share of cumulative traffic impacts . In this Agreement , <br /> the developer shall agree to pay his fair share of impact <br /> fees as identified in the Project Study Report to be pre- <br /> pared for the Kearny Ventures project . Preliminary copies <br /> of this Agreement shall be submitted to the Planning <br /> Director and the City Attorney for review and approval . <br /> 2 . United States Department of the Army: <br /> a. A perpetual assignable easement shall be granted to the U. <br /> S . Government and the County of San Joaquin which will <br /> permit overflight of the property by aircraft and any <br /> noise or other emissions which are inherent in the opera- <br /> tion of aircraft . This easement shall be recorded as a <br /> deed restriction flowing in perpetuity to all successor <br /> property owners . <br /> b. The applicant shall agree to implement the procedures of <br /> the California Real Estate Association concerning the <br /> notice and disclosure of the fact that the subject pro- <br /> perty is in the vicinity of an airport and is exposed to <br /> significant noise levels. <br /> 3 . Department of Public Works : <br /> a. All improvements shall be in conformance with the <br /> Improvement Standards and Specifications of the County of <br /> San Joaquin. All improvement plans and specifications <br /> must be approved by the County of San Joaquin Department <br /> of Public Works prior to approval of the Final Map. <br /> b. All interior streets, except Fifth Street and Seventh <br /> Street , shall be dedicated and improved to County stan- <br /> dards for a 50-foot-wide right-of-way urban street . <br /> c . Fifth Street shall be dedicated and improved in confor- <br /> mance with an 84-foot-wide right-of-way urban street from <br /> Louise Avenue to Mingo Way and with a 60-foot-wide right- <br /> of-way urban street from Mingo Way to "0" Street . <br /> Conditions of Approval - 1 - (SU-89-16) <br />
