The following is an itemized list of hazardous waste violations that have not been <br /> addressed for HERNANDEZ AUTO PAINT as of Apri109 , 2020 . <br /> Open violations from April 08, 2019 inspection <br /> Violation #102 - Failed to determine if a waste is a hazardous waste . <br /> According to the owner, Hernandez , sanding dust is swept up and thrown into the trash . Hernandez said that the <br /> waste would start to be handled as a hazardous waste . <br /> The following wastes were found in the backyard area : <br /> -One black 55 gallon steel drum contained an unknown solid (full ) <br /> -One blue 55 gallon steel drum containing an unknown liquid (full) <br /> -One white 55 gallon poly drum contained an unknown liquid (full ) <br /> -Two yellow 1 gallon buckets contained an unknown solid (full ) <br /> -Twelve 5 gallon buckets contained an unknown waste (each had waste in it) <br /> -Two red 5 gallon buckets contained a paint waste (each 1 /2 full ) <br /> Immediately , make a complete hazardous waste determination for the above wastes , and manage them according <br /> to Title 22 hazardous waste regulations . Submit a statement and supporting documentation explaining how these <br /> wastes were managed . <br /> ❑ This violation was corrected ❑ This violation will be corrected by ( date) : <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation : <br /> Violation #110 - Failed to keep signed copy of manifests from the designated facility for three years . <br /> Copies of uniform manifests for the disposal of hazardous waste for 2016 , 2017 , 2018 , and 2019 were not found on <br /> site for paint solids and water based paints . Hazardous waste generators shall retain copies of all manifests signed <br /> off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and <br /> have them readily available for review. Immediately locate a copy of all manifests and receipts for the last three <br /> years , maintain them on site , and submit copies to the EHD . <br /> i <br /> i <br /> f Manifest numbers 017792233JJK (3/ 12/2018 ) and 017792234JJK ( 3/ 12/2018) were not found on site . Hazardous <br /> waste generators shall retain copies of all manifests for three years or until a copy signed off by the destination <br /> facility is received . The signed off copy shall be retained and made readily available for review for three years . If <br /> the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the <br /> facility to which the generator' s waste was submitted within 60 days of the date the waste was accepted by the initial <br /> transporter, the generator shall submit a legible copy of the missing manifest, with some indication that the <br /> generator has not received confirmation of delivery . This information shall be submitted to : <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P . O .
