The following is an itemized list of hazardous waste violations that have not been addressed for HERNANDEZ AUTO PAINT as of Apri109 , 2020 . Open violations from April 08, 2019 inspection Violation #301 - Facility not maintained to minimize the release of a hazardous waste . Oily staining was observed on the ground near the east side of the fence where old oil containers were located . An oily puddle was observed on the ground near three 55 gallon drums on the east side of the backyard . One paper and two metal used oil filters were observed on top of two 55 gallon drums on the east side of the backyard . Saturated oily absorbent was observed on the ground at the base of a 55 gallon steel drum that held used oil . The drum was located near the exit of the backyard into the shop . Facilities shall be maintained and operated to minimize the possibility of a fire , explosion , or release of hazardous waste to air, soil , or surface water which could threaten human health or the environment Immediately clean the above wastes and manage them according to Title 22 hazardous waste regulations . Submit a statement and supporting documentation explaining how these wastes were managed . ❑ This violation was corrected ❑ This violation will be corrected by (date) : ❑ Supporting documents included Describe actions taken or will be taken to correct violation : Violation #406 - Contaminated container not marked with date emptied or managed within one year of being emptied . One blue 55 gallon steel drum that contained used oil was observed without an empty label . Containers larger than five gallons that previously held a hazardous material shall be marked with the date they were emptied and managed within one year of being emptied . Immediately mark and manage all empty containers per this section . The following containers were observed without an accumulation start date in the waste paint area : One black 30 gallon steel drum contained a solid waste paint One black 30 gallon steel drum contained a water based paint Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days . Since it cannot be determined how long these hazardous wastes have been on site , immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest.
