Based on the investigation results, combined with SAIC's risk <br /> screening evaluation and ecological receptor query, the documentation provides the appropriate <br /> technical data and rationale to support an NFAR determination. <br /> On 13 March 2032, Central Valley Water Board staff notified owner(s) of property determined to overlie <br /> the affected area(s) and owner(s) of property within a 200-foot radius of the approximate boundary of <br /> affected soil and/or groundwater, of Chevron's request for NFAR determination. Comments from a <br /> representative of a nearby property owner were received during the public notification review period. <br /> The matter was addressed and no further comments were received. <br /> Central Valley Water Board staff received the 13 October 2011 Soil and Groundwater Management <br /> Plan (SGMP) that provides guidance for whoever may conduct future excavation and/or maintenance <br /> activities at the Site. The SGMP designates Chevron as the responsible party for any issues that arise <br /> confirmed to be related to the crude oil leaks. <br /> Provided the information submitted to this agency was accurate and representative, no further action is <br /> required at the Site. if existing, additional, or previously unidentified chemical constituents confirmed to <br /> be associated with the former crude oil pipelines and/or pump station at the Site, cause or threaten to <br /> cause pollution or nuisance, or are found to pose a threat to public health or water quality, then: 1) <br /> nothing in this determination is intended or shall be construed to limit or preclude the Central Valley <br /> Water Board or any other agency from taking enforcement action, and 2) this letter does not relieve <br /> Chevron of any responsibilities mandated under the California Health and Safety Code or the California <br /> Water Code. <br /> Any person aggrieved by this action may petition the State Water Board to review the action in <br /> accordance with Water Code section 13320 and California Code of Regulations, title 23, sections 2050 <br /> and following. The State Water Board must receive the petition by 5:00 p.m., 30 days after the date of <br /> this action, except that if the thirtieth day following the date of this action falls on a Saturday, Sunday, or <br /> State holiday, the petition must be received by the State Water Board by 5:00 p.m. on the next <br /> business day.
