SAN J O A Q U I N Environmental Health Department <br /> COUNTY <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> S-MART#334 1 3215 PACIFIC AVE, STOCKTON June 05, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS 1,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 104 CCR 66262.34(d)(2)No modified contingency plan. <br /> OBSERVATION: The modified contingency plan posted at the facility does not list the current emergency <br /> coordinator.The emergency coordinator,Terrie Lucas, listed on the plan at the time of inspection, no longer works <br /> at this facility, per Sandra Meza,the store manager. <br /> REGULATION GUIDANCE: The business operator must post the following information next to telephones or in <br /> areas directly involved in the generation and accumulation of hazardous waste: the name and emergency <br /> telephone number of the emergency coordinator, the location of fire extinguishers and spill control material,and <br /> the telephone number of the fire department unless the facility has a direct alarm. <br /> CORRECTIVE ACTION: Immediately update the modified contingency plan and post the required information at <br /> the facility. Provide a statement to the San Joaquin County Environmental Health Department that the correction is <br /> complete. <br /> This is a Class II violation. <br /> 106 CCR 66262.34(d)(2)Failed to train employees on waste handling and emergency procedures. <br /> OBSERVATION: At the time of inspection, it could not be demonstrated(not necessarily documented)that <br /> employees who handle hazardous waste were properly trained, based on the following observations: <br /> 1.A leaking 16 fl.oz. bottle of Cremo Body Wash and a 32 fl.oz. bottle of Shout Pets Oxy floor cleaner were found <br /> partially empty inside a"Hazardous Waste State Regulated,Toxics,OTC Pharmaceuticals&Universal Waste" <br /> container. Sandra Meza,the store manager,did not know what happened to the missing chemical liquids, and <br /> indicated when a hazardous chemical spills or leaks in the facility,the spill or leak is cleaned up using absorbent or <br /> paper towels,and the waste generated from the clean-up is placed in a hazardous waste container along with the <br /> leaking item. Used absorbent or paper towels were not found inside the hazardous waste container at the time of <br /> inspection. <br /> 2. See violations 403 and 605. <br /> REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with <br /> proper waste handling and emergency procedures, relevant to their responsibilities during normal facility operations <br /> and emergencies. <br /> CORRECTIVE ACTION: Immediately train or re-train the employees.
