In determining whether a violation is chronic or a violator is recalcitrant , the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 ( not including corrective action ) . On 12/3/2019 , Stacy Rivera of the San Joaquin County Environmental Health Department (EHD) performed a routine underground storage tan inspection at the above reference site . The site was found to be out of compliance. The violations include but are not limited to the following : -A permit to operate the UST system has not been issued . No person may own or operate an UST unless a permit for its operation has been issued b the local agency to the owner or operator of the UST system . (HSC 25284) -An inspection was last done on 12/11 /18 and an inspection report was issued identifying information to be submitted to bring this site into compliance . This information was required to be submitted by 1 /10/19 . This information has not been fully received resulting in a non-compliant status for this facility. (CCR 2712(f)) -The site has flexible primary and secondary piping . During the field inspection it was observed that the test boots appeared completely sealed in the 87 product and 91 product lines in all UDCs . Any potential release from the primary containment into the secondary containment in the 87 product and 91 product piping does not flow into a UDC collection sump to detect a leak at the earliest opportunity. A repair permit was obtained to address this issue , but no work has been conducted . (CCR 2630 , 2641 (a)) -Failure to comply with section 9 . 2 of the Consent Order, effective date August 27, 2019 , Section 9. 2 reads "No later than 10 days from receipt of approval of Underground Storage Tank Retrofit or Piping Repair Permit, from the CUPA, work to commence at the site ." The repair permit was approved on November 14 , 2019 and emailed to the contractor and the operator on November 18 , 2019 . The contractor confirmed receipt of the approved permit . As of December 3 , 2019 work has not commenced at this site. The site must be brought into compliance to avoid the entire UST system being red tagged 7-days from the receipt of this Notice.
