SAN 10AQUIN <br />COUNTY - <br />ear Mr. Sidhu et al., <br />Environmental Health Department <br />On December 11, 2018, representatives of the San Joaquin County Environmental Health <br />Department ("EHD"), which is the certified unified program agency ("CUPA") in this <br />jurisdiction, conducted an inspection at 3032 E. Waterloo Road , Stockton CA 95205 <br />(hereinafter "Facility"). During that inspection, EHD discovered violations of the law and, <br />based on those findings, EHD is prepared to bring an administrative action against you <br />pursuant to California Health and Safety Code Section 25404.1.1. The administrative action is <br />to ensure compliance with applicable statutes and assess penalties for violations. A copy of <br />the inspection report is enclosed. <br />EHD has found that the Facility is in violation of the following regulations: <br />1. 23 CCR § 2630(d) which states "All monitoring equipment used to satisfy the <br />requirements of this article shall meet the requirements of section 2643(f) and shall <br />be installed and maintained such that the equipment is capable of detecting a leak <br />at the earliest possible opportunity. Additionally, all monitoring equipment used to <br />satisfy the requirements shall be installed, calibrated, operated, and maintained in <br />accordance with section 2638. <br />2. HSC § 25284(a)(1) which states "Except as provided in subdivision (c), no person <br />may own or operate an underground storage tank unless a permit for its operation <br />has been issued by the local agency to the owner or operator of the tank, or a <br />unified program facility permit has been issued by the local agency to the owner or <br />operator of the unified program facility on which the tank is located. <br />All penalties for these violations will be calculated pursuant to the appropriate California law. <br />Some applicable penalties may accrue on a daily basis unless and until the conditions are <br />abated. <br />If no action is taken to abate the conditions at the Facility as described in the inspection report <br />then EHD will file an Administrative Enforcement Order and Notice of Defense (hereinafter <br />"Order") against you. <br />However, EHD is extending you the opportunity to advise of any other information that you <br />believe should be considered before the EHD files an Order against the you. Further, EHD is <br />willing to discuss with you options for settlement of these issues without further enforcement <br />action.
