14900 West Highway 12 <br />Lodi, CA 95242 <br />(209) 369-1041 <br />TOWER PARK MARINA <br />HAZARDOUS MATERIAL EMERGENCY RESPONSE PLAN <br />Revised: JUNE 2020 <br />1.0 Policy <br />It is the policy of TOWER PARK MARINA located in LODI, CALIFORNIA that all hazardous waste <br />management be conducted in accordance with Cal -OSHA, Cal -EPA, Federal EPA, and other regulatory <br />guidelines. This program is designed to ensure proper management of hazardous materials/wastes, to <br />identify where wastes will be accumulated and stored, and to define the roles and responsibilities for all <br />persons who will be responsible for handling hazardous materials/wastes at TOWER PARK MARINA. No <br />person shall accumulate, store, treat, or dispose of hazardous materials/wastes without following the <br />procedures set forth in this program. <br />2.0 Regulatory Authority <br />CFR Title 40, §260.1 Hazardous Waste Management <br />CCR Title 22, §66262.1 et al, Standards for the Management of Hazardous Waste <br />CCR Title 8, §3220 Emergency Action Plan <br />CCR Title 8, §5192 Hazardous Waste Operations and Emergency Response <br />CCR Title 8, §5194 Hazard Communication <br />California Health and Safety Code, §25100 Hazardous Waste Control Law <br />3.0 Definitions <br />Acutely hazardous waste: <br />Commercial chemical products, manufacturing chemical intermediates, or off -specification chemical <br />products or manufacturing chemical intermediates referenced in 22 CCR §6621.33(e). <br />Extremely hazardous waste: <br />Any hazardous waste or mixture of hazardous wastes which, if human exposure should occur, may likely <br />result in death, disabling personal injury, or serious illness caused by the hazardous waste or mixture of <br />hazardous wastes because of its quantity, concentration, or chemical characteristics. <br />Hazardous material: <br />Any chemical or radioactive material used in research, custodial, physical plant maintenance, grounds, <br />facilities maintenance, or educational activities, etc., which poses a health and safety threat to employees <br />and/or guests or a threat to the environment as a result of improper handling or disposal methods, or <br />accidental release/discharge. <br />Hazardous waste: <br />Any discarded material in any form that is: 1) not excluded as a waste or hazardous waste, 2) is "listed" <br />as a hazardous waste, and 3) exhibits any characteristics of a hazardous waste. Chemicals which have <br />been used in a process or experiment and are contaminated or no longer necessary, or chemical <br />byproducts of a process or experiment that have no further research, equipment or facilities value. <br />Hazardous wastes also include the following: <br />• Chemicals that can no longer be used for their intended use <br />• Mislabeled or unlabeled chemicals <br />2 <br />
