TEXT AMENDMENT APPLICATION NO. 7A-93-6 OF GEORGE BROWN for an <br /> Ordinance to amend Title 9 of the Ordinance Code of the Countv <br /> of San Tcaquin to allow the removal of excavated materials for <br /> private ponds . The project is applicable CountFaide . <br /> Tom Gau, Senior Civil Engineer, introduced the staff report into <br /> the record. <br /> PUBLIC HEARING OPENED: <br /> PROPONENTS: <br /> George Brown (23627 N. DeVries Road, Lodi) said he agrees with the <br /> staff report. <br /> OPPONENTS: <br /> Russ Matthews (Farm Bureau, 3290 Ad-Art Way, Stockton) said that <br /> the proposed Text Amendment could be made to work, with the <br /> exception that dirt should not be removed from agricultural land. <br /> The dirt removed during excavation could be used on the site for <br /> landscaping. <br /> REBUTTAL: <br /> George Brown said that dirt could be removed from the site to a <br /> another site within the County. He would like to do this but have <br /> safeguards built in to prevent dirt farming. <br /> PUBLIC HEARING CLOSED: <br /> Comm. Morri said he would like to see any excavated soil stay in <br /> San Joaquin County. The pond should be accessory to the primary <br /> residence on the property. <br /> Comm. Fortney recommended amending Section 9-1420 . 3 (c) to read "no <br /> dirt may be removed from the Countv" and Section 9-1420 . 3 (e) to <br /> read "existing primary residence. " <br /> Comm. Demichelis said he was opposed to moving dirt off the site. <br /> He said a 20-year bond could be set up to buy back the dirt if the <br /> pond needs to be filled back in. He said the pond should be set <br /> back 200 feet from the property lines. <br /> MOTION: <br /> Moved, seconded (Fortney/Carter) , and passed by a -ajcrity ro11 <br /> call vote (6-1; Demichelis, No) to : <br /> 1 . adopt the Negative Declaration, and <br /> 2 . .--'yard Text amendment Application No . 7-1--93-6 to the Board of <br /> PC M-TNL;TES ��-, 9-13-94 <br /> -12- <br />
