(1) Not result in disruption of the flow of drainage water from the property or <br /> adjoining properties: and <br /> (2) Not adversely affect the relation of the water table to the surface of the land and <br /> at a minimum ther shall be a five (5) foot separation between the bottom of the <br /> pond and the highest recorded ground water level.: <br /> (h) Hours of Ooeration. Excavation operations shall not be carried on during the hours from <br /> nine (9) p.m. through five (5) a.m., except during periods of declared national state or <br /> local emergencv. Said hours shall be based on either Pacific Standard Time or Pacific <br /> Davlight Saving Time, whichever is legally in effect. The hours of operation may be <br /> modified by the Review Authority based upon the excavation's potential Affect on <br /> surrounding land uses: <br /> Emissions. All emissions shall be subject to the rules and regulations of the San Joaquin <br /> County Air Pollution Control District: <br /> El Need Control. If noxious weeds are on the site. ocerations shall be in accordance with <br /> instructions from the Acricuitural Commissioner of San Joaquin County: <br /> (k) Heaith Considerations. Excavations shall not cause health or sanitary hazards and shall <br /> net create conditions which will cause the breeding or increase of mosquitos, rodents. <br /> or other oests: <br /> (1) Commencement of Work. A written notification of work schedules s"ail be provided to <br /> the Countv by the apolicant prior to initiating any grading or excavation: <br /> (m) Certification of Compliance. At the completion of the grading, the apolicant shall have a <br /> registered civil engineer or licensed land survevor compare the excavation's final <br /> eievations with the acoroved oermit. The engineer or sur/evor shall submit a certified. <br /> wrir-zen fincine to the Building Official whic" states and documents :he compliance or <br /> nen-compliance of the excavation with the aporoved oermit. if the croiect conforms with <br /> the aporoved permit. the Review Authority shall accept the certification. <br /> (n) 7me Limitation. The time limit shall be based upon the characteristics of the proposal. <br /> inclucire. but not limited to. the auantity of material to be removed and the applicant's <br /> time sc;iedule and chasinc clan. Specific time limitation may be recuirec+ for individual <br /> chases of the excavation. <br /> C) =erfcrmance Guarantee. To ensure that the excavation is comcleted in conformance with <br /> t"e accroved oermit. the operator shall secure a performance bond or other financial <br /> 1»20-2 <br /> -29- <br />
