The intent of adding Chapter 9-1420, Pond Excavation, is to provide standards for removing excess material from property for the construction of ponds for water supply and recreational purposes. The key points of the development standards are as follows: • The parcel shall be at least 20 acres in size. • The surface area of the pond shall not exceed two acres. • The pond shall be accessory to an existing residence. • No more than 35,000 cubic yards of material can be removed from the site. • The maximum depth of the pond shall not exceed 12 feet. • A Certificate of Compliance will be required by a Registered Engineer or a Licensed Land Surveyor to certify that the pond excavation was completed in compliance with the approved excavation permit. • A Performance Guarantee shall be required to ensure that the pond is constructed in accordance with the permit and to provide sufficient coverage to ensure that the site can be rehabilitated for agricultural purposes in the event the construction of the pond does not comply with the permit. The bond shall remain in place for a minimum of one year after the Certificate of Compliance. • The pond shall be designed by a Registered Civil Engineer. • A Grading Permit is required.
