U.S. ARMY CORPS OF ENGINEERS <br /> ACCESS AGREEMENT FOR SURVEY AND EXPLORATION <br /> PROJECT: FARMINGTON GROUNDWATER CONTRACT NO. DACW05-01-D-0013 <br /> RECHARGE PROGRAM <br /> The undersigned, hereinafter called "Owner," hereby grants to the UNITED STATES OF <br /> AMERICA, hereinafter called "Government," and its designated agents, a right-of-entry permit <br /> to the property located in the State of California, County of San Joaquin, described as Assessor's <br /> Parcel No. OS 1 -[Z-91 as highlighted in attached map. The permit is issued for the <br /> survey and exploration of said lands for participation in the Farmington Groundwater Recharge <br /> Program, hereinafter called "Program," as described in the below terms and conditions: <br /> 1. The Owner hereby grants to the Government the right to enter the lands herein <br /> described at anytime during normal business hours during the period of two years from the <br /> signing of this instrument to survey, conduct test boring and sampling, and carry out such other <br /> exploratory work, as delineated in paragraph 2, which may be necessary to complete the <br /> evaluation of said lands by the Government for the Program. The Government will provide 24- <br /> hour prior notice to the owner before each entry by E-mail (Owner E- <br /> mail: j K act is @ lod;nef•coc ), or by telephone if E-mail is not available(Owner <br /> telephone number: Zoq- 33,-I - N'ls 6 ). Owner agrees to notify the Government in the <br /> event of a change of E-mail and telephone number, and recognizes that said advance notice is <br /> provided by the Government as a courtesy and is not required for said entry. All activities of the <br /> Government or its contractors hereunder will be performed in a lawful and prudent manner. Any <br /> permanent or semi-permanent structures will be installed following consultation with Owner in a <br /> good faith effort to eliminate or limit interference with the normal activities of Owner operation. <br /> 2. Scope of work shall include but not be limited to the following: Conduct test <br /> boring for soil sampling and percolation testing, installation of one shallow monitoring well for <br /> groundwater sampling, and developing pilot scale short duration flooded field infiltration test. <br /> Flooded field infiltration testing shall consist of a pilot scale test for a 4 to 6 week period on a <br /> plot no larger than 100 feet by 100 feet in area. Upon completion of the sampling effort, all <br /> holes and minor grading activities for the flooded field test will be backfilled and restored per <br /> State of California requirements. After testing activities are completed the shallow zone <br /> monitoring well shall either be abandoned per State of California requirements or shall be <br /> transferred as property of the landowner and therefore under the landowners responsibility. <br /> 3. The Owner also grants the right to enter and exit over and across any other lands of <br /> the Owner as necessary to use the described lands for the purposes listed above. <br /> Pase 1 of 2 <br />
