Washington Street within the Port of <br /> Stockton. Staff have also reviewed the case file and the reports which detail the soil and groundwater <br /> investigation at this property. The reports contain information regarding collection of soil samples, <br /> installation of five monitoring wells, and five years of groundwater monitoring. <br /> Although a large mass of nitrogen-contaminated soil was found beneath the site in 1993, groundwater <br /> monitoring has shown that it has had little or no deleterious effect on the shallow groundwater. In <br /> addition, portions of the contaminated soil were excavated in 1995 during tank farm construction, and <br /> the remainder is now under a concrete cap. <br /> Staff hereby conditionally approve Unocal's request for no further action for the soil and groundwater at <br /> the site. This approval is conditioned upon keeping monitoring wells MW-2 and MW-8 open and <br /> allowing outside consu tants access on a quarterly asls to collect water samples. These samples are <br /> needed to monitor the progress of the groundwater investigation and remediation at two adjacent <br /> properties. Monitoring wells MW-3, MW-4, and MW-7 may be abandoned in accordance with any <br /> necessary local permits. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from liability <br /> for any conditions or claims arising as a result of past, current, or future operations at this location. <br /> Nothing in this determination is intended or shall be construed to limit or preclude the Regional Board <br /> or any other agency from taking further enforcement action. This letter does not relieve Unocal of any <br /> responsibilities mandated under the California Health and Safety Code and the California Water Code if <br /> existing, additional, or previously unidentified contamination at the site causes or threatens to cause <br /> pollution or nuisance or is found to pose a threat to public health or water quality. <br /> California Environmental Protection Agency <br /> �a Recycled Paper <br /> t• <br />
