q <br /> i <br /> RIGHT OF ENTRY <br /> r <br /> The ,property owner, referred to in this Agreement as the "Owner", has the sole right to the <br /> property for which right of entry is granted. The property is located at: <br /> California Western Farm Supply Site <br /> 2040 West Washington Street <br /> Stockton, California <br /> The "Owner gives Unocal Corporation (the Licensee), its agents, employees, and assigns, the <br /> right to enter upon the property to measure water levels of monitoring wells and take ground- <br /> water samples for TKN, .nitrate, and total mineral analysis, and to do all activities required to <br /> complete their work. The Owner ` and the Licensee acknowledge that Sierra-Pacific <br /> Groundwater Consultants, Inc. (Sierra-Pacific) is an agent of the Licensee. <br /> This License is effective immediately upon signing.' Licensee agrees to repair any damage to <br /> the property resulting from entry onto the property by Licensee, its agents, employees, or <br /> assigns by restoring the property, as much as reasonably possible, to its condition immediately <br /> prior' to the entry. <br /> Sierra-Pacific will not be held responsible for the cost of ground-water or soil remediation should <br /> contaminants be discovered as a result of Sierra-Pacific's sampling and contract analytical work. <br /> Each of the monitoring wells proposed to be sampled was originally installed in response to,some <br /> earlier regulatory directive, and ground water contaminants have already been identified in the <br /> Washington Street area. <br /> Dated this 151 day of March, 1994. <br /> Owner Licensee <br /> Bank of America Unocal Corporation <br /> Catherine Whitworth John Stephen Rapp <br /> Trustee Senior Engineering Geologist <br />
