THERMO FLEIIDS 4 1 EMERALD` <br /> PROTECB3Ri=(:W S-PBCPLE OIL FILTER RECYCLERS An av:rOil2in;R3�vn.:np.ipy <br /> MAKE GRE WORK <br /> The Responsible SchRien <br /> Regu atory Agency Enforcement Alert — Used Oil Filters <br /> Effective imediately, both state and federal (EPA) hazardous waste regulations require that any container <br /> of used oil fil ers that is found to have either non-metal used oil filters (or trash) or metal filters that have <br /> not been properly hot-drained must be handled as a non-RCRA hazardous waste and sent to secure disposal <br /> at a hazardol11s waste landfill. The landfill disposal is required because these filters are not considered <br /> exempt from the hazardous waste regulations by the local, state and federal regulatory agencies. <br /> Used oil filters are exempted from these regulations only if the filters: (1) are properly drained of all free- <br /> flowing oil; and, (2) contain steel that is sent for reclamation/recycling. <br /> • Used oil and fuel filters must be drained of all free-flowing oil or fuel before they are placed in storage <br /> containers! The term "free-flowing" means a continuous stream of used oil from the filter when it is <br /> turned over. Used oil that flows drop-by-drop is not considered to be free-flowing. <br /> • If the filter is equipped with a flapper valve or other device that blocks the drainage, the valve must be <br /> opened, or the filter case punctured or opened, to allow the residual used oil or fuel to drain freely. <br /> • Paper and Paper/Plastic cartridge used oil and fuel filters are not exempted by the regulations and must <br /> be managed separately from the properly hot-drained metal used oil and fuel filters. <br /> Federal (EPA)IRegulations: <br /> 40 CFR §261.4(b): Exclusions: solid wastes which are not Hazardous Wastes <br /> (13) Non-terne plated (metal) used oil filters that are not mixed with wastes listed in subpart D of <br /> this part if these oil filters have been gravity hot-drained using one of the following methods: <br /> (i) Puncturing the filter anti-drain back valve or the filter dome end and hot-draining; <br /> (ii) Hot-draining and crushing; <br /> (iii) Dismantling and hot-draining; or <br /> (iv) Any other equivalent hot-draining method that will remove used oil. <br /> The regulatory agencies are actively enforcing these used oil filter standards; violations (if found) can result <br /> in expensive penalties levied against the generator. <br /> Effective Nov mber 1sT 2016, if landfill disposal is required for any non-conforming used oil filter containers, <br /> then it will result in an additional service charge to the customer.
