Metal fines generated from metal grinding in the auto shop are being thrown in the garbage, as stated by the auto shop mechanic,without first determining particle size or hazardous properties. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop throwing the metal fines in the garbage, make a hazardous waste determination for the metal fines, and manage it according to Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and supporting documentation explaining how this waste was managed. This is a repeat violation, Class II. _ 108 CCR 66265.52 Contingency plan is incomplete. The facility's contingency plan is incomplete. Current telephone number for State Office of Emergency Services (800-852-7550)is missing. The contingency plan must include: 1. Description of actions facility personnel will take in response to fires, explosions, or any sudden or non-sudden release of hazardous waste to air,soil or surface water at the facility; 2. Description of arrangements made with local police departments, fire departments, hospitals, contractors and State and local emergency response teams to coordinate emergency services; 3. List of names, addresses, and phone numbers(office/home/cell)of all persons qualified to act as emergency coordinator. Where more than one person is listed, one shall be named as the primary emergency coordinator and all others in order in which they will assume responsibilities; - 4. List all emergency equipment,which includes location, physical description,and brief outline of its capabilities; 5. Evacuation routes for facility personnel where there is a possibility of evacuation; 6. Current telephone number for State Office of Emergency Services. If the facility has a Spill Prevention, Control and Countermeasures plan, or some other emergency or contingency plan,the owner or operator need only amend that plan to incorporate hazardous waste management provisions that are sufficient to comply with the requirements of this chapter. Immediately prepare or amend an existing plan to fulfill the requirements of this chapter. Submit a copy of the contingency plan to the EHD. This is a repeat violation,Class II.
