Kile Rd., Lodi, CA <br /> Mr. Gooderham: <br /> In response to your phone call today, this letter addresses the issue of "new development" on <br /> the above project site. <br /> Mr. Ackerman does not propose any new construction. It is Live Oak's understanding that the <br /> carriage house on the site was converted into one-bedroom apartment without a permit and <br /> prior to Mr. Ackerman's ownership. The carriage house septic system predated the apartment <br /> and was installed in the 1920s or earlier (personal communication, April 14, 2020). <br /> Per our phone call this afternoon, however, Live Oak understands that San Joaquin County <br /> considers the apartment and septic system to be "new development" because no prior records <br /> have been identified. Therefore, on page 1 of the Soil Suitability/Nitrate Loading Study <br /> (SSNLS), the existing apartment should be considered the "proposed development." On page <br /> 2, the existing septic system that serves the apartment should be considered the "proposed <br /> septic system." The final line on page 8, "No new construction is anticipated," should read, "No <br /> new construction is anticipated; however, San Joaquin County considers the existing apartment <br /> and associated septic system to be new development because no prior records have been <br /> identified."
