shows compliance with paragraph 3. <br /> 5. OWNER(S) agree to include, in any sales or transfer of interest in any part or the whole of <br /> the property covered in paragraph 3, the requirement that any subsequent sale of the property <br /> will only be to households which qualify as low income households. This restriction will <br /> remain in effect for ten (10) years from the first purchase date by a qualified low income <br /> household. <br /> 6. COUNTY agrees to assure the continued affordability of the above housing unit(s) for ten <br /> (10) years from the first purchase date by a qualified low income household, as required by <br /> Section 65915(c) of the Government Code, by monitoring any subsequent resale of the <br /> housing units. <br /> 7. Upon, written notification to proceed by COUNTY, OWNER(S) will design and prepare <br /> construction drawings for the required housing unit to be approved by the Director of the <br /> Community Development Department. Said drawings shall be submitted within 30 days after <br /> notification and construction shall commence with 180 days after approval of the construction <br /> drawings. <br /> 8. This AGREEMENT consisting of the burdens of constructing and/or paying for the costs of <br /> said low income unit is intended to run with the land described in Exhibit(s) A and is binding <br /> on the heirs, successors and assigns of OWNER(S) and the benefit is to run to the successors <br /> and assigns of COUNTY. <br /> 9. In the event of litigation occasioned by any default by OWNER(S), OWNER(S) agree to pay <br /> all costs involved,including reasonable attorney's fees, and that the same shall become a part <br /> of the lien against said real property. <br /> 10. OWNER(S) agree to include in any sales agreement or transfer of any interest in any portion <br /> or the whole of the property which is covered by this AGREEMENT, the requirement that <br /> the Buyer/Transferee assume the responsibilities set forth in this AGREEMENT, as to the <br /> property and agrees to be subject to the terms and conditions herein, as an heir, successor or <br /> assign of OWNER(S). OWNER(S) shall require the Buyer/Transferee to sign an <br /> acknowledged and notarized statement substantially in the following form: <br /> "Buyer/Transferee hereby acknowledges and assumes all responsibility to the <br /> construction of one low income unit related to the property for which <br /> Buyer/Transferee is acquiring an interest, in accordance with the terms and conditions <br /> of Agreement CAA-94-_between San Joaquin County and recorded as part of the <br /> Official Records of San Joaquin County." <br /> This statement shall be delivered to the San Joaquin County Director of the Community <br /> Development Department prior to the transfer of any interest in the parcel covered by this <br /> AGREEMENT. <br /> -2- <br />
