As noted in the Initial Study, DTSC is currently he oversight agency for <br /> environmental impacts at the American Moulding and Millwork ite (Site), which <br /> corresponds to a major portion of the subject residential project. DTSC has reviewed <br /> the submitted documents and has the following comments: <br /> • The public documents (reports, notices, etc.) need to clearly state the residential <br /> project is a portion of a Site listed on the Hazardous Waste and Substances <br /> Sites (Cortese) List. This is a requirement per the California Public Resources <br /> Code, Division 13 (Environmental Quality) Section 21092.6 (see attached). <br /> DTSC would recommend this statement be presented in the introduction or <br /> project summary and not exclusively within text dealing with hazardous <br /> substances. <br /> • The description provided in Section B.13 appears adequate. However, please <br /> note that if Site Certification is not completed under a Voluntary Cleanup <br /> Agreement (VCA), DTSC could pursue an enforceable order to protect public <br /> health. <br /> • The Environmental Impact Report (EIR) should adequatly address the <br /> hazardous substance impacts at the Site. Therefore, the EIR will need to <br /> reference the potential public health impacts from approximately seven acres of <br /> the Site located adjacent southwest to the proposed residential project area. <br /> 0 Printed on Recycled Paper <br />
