WASTE DISCHARGE REQUIREMENTS ORDER NO.R5-2003-.N)M • 18 <br /> SPX CORPORATION <br /> MARLEY COOLING TOWER COMPANY <br /> SAN JOAQUIN COUNTY <br /> issued by the Executive Officer on 10 September 2001. A copy of that letter, including it's <br /> Attachments I though IV, are incorporated into this Order as Attachment E. The results of <br /> this effluent and receiving water study were submitted in March 2003. If after review of <br /> the study results it is determined that the discharge has reasonable potential to cause or <br /> contribute to an exceedance of a water quality objective this Order will be reopened and <br /> effluent limitations added for the subject constituents. <br /> 3. TDS, Effluent Limitation Time Schedule: Effluent Limitation B.5 requires the <br /> Discharger to comply with a new monthly average effluent limitation for TDS of 500 mg/L <br /> (ppm)by 1 February 2008. The Discharger shall comply with the following time schedule <br /> in order to study and implement measures necessary to comply with this new limitation: <br /> Task Comnllance Date <br /> Submit Compliance Alternatives Study Workplan 1 September 2003 <br /> Submit Compliance Alternatives Study Report 1 January 2005 <br /> Submit Implementation Plan and Time Schedule for 1 July 2005 <br /> Selected Alternative(s) <br /> Submit Progress Report 1 January 2006 <br /> Submit Progress Report 1 January 2007 <br /> Achieve Full Compliance 1 February 2008 <br /> The Discharger shall submit to the Regional Board on or before each compliance report <br /> due date, the specified document or, if appropriate, a written report detailing compliance or <br /> noncompliance with the specific schedule date and task. If noncompliance is being <br /> reported, the reasons for such noncompliance shall be stated, plus an estimate of the date <br /> when the Discharger will be in compliance. The Discharger shall notify the Regional <br /> Board by letter when it returns to compliance with the time schedule. <br /> 4. Copper, Effluent Limitation Time Schedule: Effluent Limitation B.5 requires the <br /> Discharger to comply with new monthly average effluent limitations for total copper. It is <br /> unknown if the Discharger can comply with these new limitations. Additional copper data <br /> must be provided with a minimum detection level below the controlling water quality <br /> criterion concentration. Within eighty (80) days of adoption of this Order the Discharger <br /> shall complete and submit a compliance schedule justification for copper. The compliance <br /> schedule justification shall include all applicable items specified by the SIP Section 2.1, <br /> Paragraph 3 (items (a) through (d)). Implementation of the new water quality based effluent <br /> limitations for copper become effective on 1 June 2003 if a compliance schedule <br /> justification meeting the requirements of Section 2.1 of the SIP is not completed and <br /> submitted by the Discharger. Otherwise the new final water quality based effluent <br /> limitations for copper required by this Order shall become effective on 1 February 2008. <br /> As this schedule is greater than one year, the Discharger shall submit semi-annual progress <br /> reports on 15 January and 15 July each year until the Discharger achieves compliance <br /> with the final water quality based effluent limitations for copper. <br />
