CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> 3443 Routier Road, Suite A, Sacramento,California 95827 <br /> PUBLIC HEARING <br /> concerning <br /> Consideration of Adoption of Waste Discharge Requirements <br /> (National Pollutant Discharge Elimination System Permit) <br /> for <br /> MARLEY COOLING TOWER COMPANY <br /> GROUNDWATER EXTRACTION AND TREATMENT SYSTEM <br /> SAN JOAQUIN COUNTY <br /> The Marley Cooling Tower Company (MCTC) owns and operates a former cooling tower fabrication <br /> plant in the East Stockton Area in San Joaquin County. As part of the fabrication operations, MCTC <br /> operated a wood preservation process utilizing solutions containing copper, chromium and arsenic. <br /> Wood preserving was discontinued at this facility in January 1991, however past operational practices <br /> have resulted in contamination of groundwater underlying the site. In an ongoing effort to remedy <br /> groundwater contamination, MCTC operates a groundwater extraction and treatment system, and <br /> discharges a maximum of 0.94 million gallons per day(mgd) of treated groundwater and storm water <br /> runoff to the Stockton Diverting Canal, a water of the United States and a tributary to the Calaveras <br /> River, at a location just south of Fremont Street. <br /> A formal public hearing considering this matter will be held during the Regional Board Meeting <br /> which is scheduled for: <br /> DATE: 17 and 18 October 2002 <br /> TIME: 8:30 a.m. <br /> PLACE: Fresno City Hall <br /> Council Chambers, 2nd Floor <br /> 2600 Fresno St. <br /> Fresno, CA 93721 <br /> The designated parties for this hearing are as follows: <br /> • Staff of Central Valley Regional Board <br /> • Representatives of Marley Cooling Tower Company <br /> Only designated parties will have these rights: to call and examine witnesses;to introduce exhibits; <br /> to cross examine opposing witnesses; to impeach any witnesses; and to rebut the evidence against <br /> him or her. All other persons wishing to testify or provide comments are interested persons and not <br /> designated parties. Such interested persons may request status as a designated party for purposes of <br /> this hearing by submitting such request in writing to the Board no later than 10 September 2002. <br /> The request must explain the basis for status as a designated parry and in particular how the person <br /> is directly affected by the discharge. <br />
