i WASTE DISCHARGE REQUIOMENTS ORDER NO. R5-2002-XXX • 16 MARLEY COOLING TOWER COMPANY SAN JOAQUIN COUNTY issued by the Executive Officer on 10 September 2001. A copy of that letter, including it's Attachments I though IV, are incorporated into this Order as Attachment E. The Discharger shall comply with the following time schedule in conducting this effluent and receiving water study and submitting reports: Task Compliance Date Submit Interim Status Report 1 November 2002 Submit Study Report 1 March 2003 Submit Interim Status Report 1 November 2003 Submit Study Report for Dioxins eP 1 November 2004 This Provision is intended to be consistent with the requirements of the 10 September 2001 technical report request described in Finding 17. The Discharger shall submit to the Regional Board on or before each compliance due date, the specified document or a written report detailing compliance or noncompliance with the specific date and task. If noncompliance is reported,the Discharger shall state the reasons for noncompliance and include an estimate of the date when the Discharger will be in compliance. The Discharger shall notify the Regional Board by letter when it returns to compliance with the time schedule. If after review of the study results it is determined that the discharge has reasonable potential to cause or contribute to an exceedance of a water quality objective this Order will be reopened and effluent limitations added for the subject constituents. 3. TDS, Effluent Limitation Time Schedule: Effluent Limitation B.5 requires the Discharger to comply with a new monthly average effluent limitation for TDS of 500 mg/L (ppm)by 1 October 2007. The Discharger shall submit a work plan providing information to show how the Discharger will comply with this limitation. A work plan shall be completed and submitted to the Executive Officer within six(6) months after adoption of this Order. The work plan shall include a schedule for completing all work in accordance with the work plan by 1 October 2007. Also, a progress report shall be submitted every six (6) months after approval of the work plan. 4. Copper, Effluent Limitation Time Schedule: Effluent Limitation B.5 requires the Discharger to comply with a new monthly average effluent limitation for total copper. It is unknown if the Discharger can comply with this new limitation. Additional copper data must ber p ovided with a minimum detection level below the controlling water quality criterion concentration.
