remediation information,- o anon, provide oversight for a Preliminary Endangerment Assessment <br /> (PEA) report to be prepared by AMMC and for AIv1MC to undertake additional remedial <br /> activities as deemed appropriate by DTSC. AMNIC submitted a PEA workplan in <br /> September 2004. Based on the fact that groundwater impacts were a concern at the <br /> Site, DTSC determined that a comprehensive health risk assessment needed to be <br /> completed in lieu of a PEA. AMMO submitted a upplemental Site Assessment and <br /> Comprehensive Risk Assessment Workplan in A Dril 2005. Between April and August <br /> 2005, AMMC ceased manufacturing operations at the Site and only remained open at <br /> the facility with sales and administrative activities. The workplan was approved with <br /> comments from DTSC on August 12, 2005. In O tober 2005, AMMC filed a voluntary <br /> Chapter 11 bankruptcy petition in the United Stats Bankruptcy Court for the Eastern <br /> District of California. In March 2006, in connection with AMMC's proposed sale of <br /> certain real property, which included the Site, AMMC, DTSC and MCD-West Lane LLC <br /> entered into the Stipulation. AMMC completed the sale of the real property and on April <br /> -.� 20, 2006, AMMC granted the Site to MCD — Lazares Stockton, LLC, for valuable <br /> consideration. Escrow closed on May 2, 2006: This VCA Amendment is based on the <br /> signed Stipulation and serves to: a) substitute MCD - Lazares LLC as the Proponent in <br /> the VCA; b) revise the Scope of Work; and, c) provide an associated Cost Estimate. <br /> Ill. AMENDMENT <br /> 3.1 Parties. The VCA in Docket No. H S-A 04105-023 is hereby amended to <br /> substitute MCD — Lazares Stockton, LLC, as the roponent in place of AMMC in this <br /> Voluntary Cleanup Agreement. <br /> 3.2 Ownership. The VCA in Docket No. HSA-A 04105-023 is hereby amended <br /> to provide that as of April 20, 20006 the Site isowned by MCD — Lazares Stockton, LLC. <br /> 634 North Santa Cruz Avenue #100, Los Gatos, California 95030 <br /> 3.3 Agreement Managers. The VCA in Docket No. HSA-A 04105-023 is <br /> hereby amended to provide that the agreement rranagers are: a) for DTSC, Mr. James <br /> Tjosvold, Chief, Northern California -- Central Cleanup Operations Branch; and b) for <br /> A Proponent, Mr. John Tomesello, owner, MCD — Lazares Stockton, LLC.
