amended to include the revised Scope of Work aS described in Attachment B hereto. The revised Scope of Work describes work conducted to April 20, 2006, and additional activities deemed necessary by DTSC in order to complete appropriate removal actions at the Site. As of the effective date of this Amendment, the revised Scope of Work as set forth in Attachment B shall replace the Scope Df Work as contained in the original VCA. 3.7 Cost Estimate. The VCA in Docket No. HSA-A 03104-111 is hereby amended to provide an estimate of the total cost (Attachment C) of DTSC's oversight of the activities described in the revised Scope of Work as contained in Attachment B. Upon the effective date of this Amendment, the cost estimate set forth in Attachment C hereto shall replace the cost estimate as contained in the original VCA. i 3.8 Advance Payment. In accordance With the provisions of the Stipulation, Proponent shall immediately make an additional advance payment of$20,000 to DTSC if it has not already done so. 3.9 Effective Date. The effective date of this Amendment is May 2, 2006 in 3 accordance with the Stipulation. 3.10 Representative Authority. Each undE rsigned representative of the parties to this Amendment certifies that she or he is fully e uthorized to enter into-the terms and conditions of this Amendment and to execute and egally bind the parties to this Amendment. 3.11 Counterparts.
