S A N J 0 A Q I I I Irl Environmental Health Department <br /> CCUN r <br /> Large Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PANELLA TRUCKING LLC 5000 E FREMONT ST, STOCKTON October 29, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 115 CCR 66262.42(a)(b)(d)Failed to comply with uniform hazardous waste manifest exception requirements. <br /> OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests <br /> (UHWM): <br /> -011209218FLE (2/14/2018) <br /> -012800765FLE (3/10/2019) <br /> -012794927FLE (6/23/2019) <br /> REGULATION: (a)A generator who does not receive a copy of the manifest with the handwritten signature of the <br /> owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial <br /> transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the <br /> status of the hazardous waste. <br /> (b)A generator shall submit an Exception Report to the Department if the generator has not received a copy of the <br /> manifest with the handwritten signature of the owner or operator of the designated facility within 45 days of the date <br /> the waste was accepted by the initial transporter.The Exception Report shall include: <br /> (1)a legible copy of the manifest for which the generator does not have confirmation of delivery; <br /> (2)a cover letter signed by the generator or the generator's authorized representative explaining the efforts taken to <br /> locate the hazardous waste and the results of those efforts. <br /> (d)Generators shall submit the exception report to the department at: DTSC Report Repository, Generator <br /> Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br /> Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be <br /> found then prepare an exception report for each missing manifest as required by Title 22 California Code of <br /> Regulations section 66262.42. The exception report shall include a legible copy of the manifest for which the <br /> generator does not have confirmation of delivery and a cover letter signed by the generator or the generator's <br /> authorized representative explaining the efforts taken to locate the hazardous waste and the results of those efforts. <br /> DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA <br /> 95812-0806. Send a copy of the exception report to DTSC and the EHD. <br /> This is a minor violation. <br /> 118 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts from 2/6/2019, 3/21/2019 and 4/22/2019 for hazardous <br /> wastes including used oil were not found on site during the inspection <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from 2/2019 to 4/2019 and <br /> maintain them on site.
