OBSERVATIONS: -In the paint shop, sanding dust generated from sanding primered trailers is disposed of into the trash without first making a hazardous waste determination. Sanding dust covered the floor inside of the paint shop. -In the machine shop, a white plastic five gallon bucket of unknown liquid was observed full to the top and overflowed onto the ground. -Plasma cutter slag and metal fines generated in the machine shop and grind shop are being recycled by A&S Metal without first making a hazardous waste determination. Metal fines were observed outside the grind shop on the concrete and collected in the cracks. Rusty staining was observed on the concrete where water has come into contact with the metal fines. A storm drain was nearby. No metal fines were observed at both inlets to the retention pond during the inspection. Metal fines were observed in the machine shop on the ground around the grinders. Oily metal fines were observed on the ground collected around machines in the machine shop. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as scrap metal. CORRECTIVE ACTION: Immediately stop disposing of sanding dust in the trash, stop recycling metal fines and plasma cutter slag and make a hazardous waste determination for the sanding dust,five gallon bucket of unknown, metal fines and plasma cutter slag. Manage the waste according to Title 22 CCR. Use Safety Data Sheets(SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status. This is a repeat violation, Class ll. 104 CCR 66262.34(d)(2)No modified contingency plan. OBSERVATION: A complete modified contingency plan was not posted at the facility. The contingency plan was missing location of spill control equipment. REGULATION GUIDANCE: The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: The violation was corrected during the inspection by filling out a modified contingency plan. No further action is required to correct this violation.
