This signed copy shall be retained as a record for at least three years from the date the <br />waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to <br />the California Department of Toxic Substances Control (DTSC) within 45 days if the destination facility signed <br />manifest copy is not received from the transporter or designated facility. <br />CORRECTIVE ACTION: Locate a copy of the destination facility signed UHWMs and send a copy to the San <br />Joaquin County Environmental Health Department (EHD). If the destination facility signed UHWMs cannot be <br />found then prepare an exception report for each missing UHWM as required by Title 22 California Code of <br />Regulations section 66262.42. DTSC address is DTSC Report Repository, Generator Information Services <br />Section, PO Box 806, Sacramento, CA 95812-0806. Send a copy of the exception report to DTSC and the EHD. <br />This is a repeat violation, Class II. <br />117 <br />CCR 66268.7(a) Failed to make determination for land disposal. <br />OBSERVATION: Uniform Hazardous Waste Manifests (UHWM) were found on-site showing disposal of hazardous <br />wastes without making a determination if the waste has to be treated before it can be disposed of to land. The <br />UHWM found on-site were missing the following information: <br />-Land Disposal Restriction Form for manifest 016020359JJK was unsigned <br />-Land Disposal Restriction Form for manifest 018243422JJK was unsigned <br />-Land Disposal Restriction Form for manifest 016020212JJK was unsigned <br />REGULATION GUIDANCE: The generator shall determine if the waste is restricted from land disposal prior to <br />transport off-site and keep complete documentation on-site for three years.
