Whereas, Licensees desire to have a technical consultant engaged by the Licensees enter <br /> the Subject Property for the purpose of performing the work as described in the <br /> Monitoring and Reporting Program No. R5-2004-0820 issued by the State of California <br /> Regional Water Quality Control Board("RWQCB"), and dated May 6, 2004 ("MRP"), <br /> attached hereto as Exhibit A. Specifically,Licensees wish to have their technical <br /> consultant enter the property on a periodic basis to gauge, sample,and inspect the deep <br /> zone monitoring wells and groundwater wells which were previously installed as required <br /> by the RWQCB. Additionally,Licensees wish to have their technical consultant enter the <br /> property to conduct periodic vacuum truck removal events,as described in the August 14, <br /> 2006 Work Scope for Ongoing SPH Removal,attached hereto as Exhibit B. <br /> Now,therefore,the Parties agree as follows: <br /> 1. Licensor hereby grants to Licensees and their agents,contractors and employees a <br /> license to enter upon the Subject Property for the purpose of performing periodic <br /> gauging, sampling,and monitoring of the deep zone monitoring wells and the <br /> groundwater wells on the Subject Property; and to conduct periodic vacuum truck <br /> removal events. <br /> 2. This license shall commence upon the execution of this Agreement and shall <br /> expire on December 31, 2010("Expiration Date").
