Staff recognizes that the Redevelopment Agency is a potentially responsible party for the site <br /> because it was an owner of the site while operations at the site were continuing (1981-1982) <br /> and because the owner/Redevelopment Agency has taken only limited actions, if any,to abate <br /> potential continuing discharges of waste from the site to groundwater since it acquired the <br /> site in 1981. <br /> Regardless of the Redevelopment Agency's status as a responsible party,the Polanco <br /> Redevelopment Act applies and would grant certain immunities from further environmental <br /> regulatory action to the Redevelopment Agency and its successors upon proper <br /> implementation of, in this case, a Water Board approved remedial action plan. Other prior <br /> responsible parties do not obtain such immunity under the Act. <br /> Please review the proposed revisions. If the Redevelopment Agency has further questions or comments <br /> regarding the proposed revisions to the Agreement,this letter or its attachments,please provide such <br /> comments in writing within two weeks from the date of this letter so that we may finalize the <br /> Agreement.
