Steve Pinkerton - 3 - 4 November 2005
Former Morton Paint Co. Site
4. Staff recognizes that the Redevelopment Agency is a potentially responsible party for the site
because it was an owner of the site while operations at the site were continuing (1981-1982)
and because the owner/Redevelopment Agency has taken only limited actions, if any,to abate
potential continuing discharges of waste from the site to groundwater since it acquired the
site in 1981.
Regardless of the Redevelopment Agency's status as a responsible party, the Polanco
Redevelopment Act applies and would grant certain immunities from further environmental
regulatory action to the Redevelopment Agency and its successors upon proper
implementation of, in this case, a Water Board approved remedial action plan. Other prior
responsible parties do not obtain such immunity under the Act.
Please review the proposed revisions. If the Redevelopment Agency has further questions or comments
regarding the proposed revisions to the Agreement, this letter or its attachments, please provide such
comments in writing within two weeks from the date of this letter so that we may finalize the
Agreement. Please feel free to contact me at(916)464-4746.
AntonieJ. rster, P.E.
Site and Groundwater Cleanup Program Manager
cc: Mr. Steven Becker& Jerry Lile, Department of Toxic Substances Control, Sacramento
Mr. Jeffrey Wong, San Joaquin County Environmental Health Department, Stockton
Ms. Barbara J.
