Madison St., Stockton address. We believe that this violation should actually be a first time violation, our <br />reasoning stated below. <br />If you look over the citations from the previous inspection of 14 November 2008, you made note that we violated rule #10 for both <br />the 345 S. Madison St and 123 W. Sonora St address'. <br />The notes given for the 345 S. Madison St. site were that we failed to determine the potential hazard of the waste of: <br />(4) 5 -gallon buckets of waste paint <br />(2) 55 -gallon drums of floor sweepings from the paint booth <br />(1) 20 -gallon container of waste paint <br />(3) containers of diesel fuel <br />The notes given for the 123 W. Sonora St. site were that we failed to determine the potential hazard of the waste of: <br />All scrap metal (to be recycled or to be determined if a hazardous waste) <br />All of these issues were dealt with in a prompt manner and the proper documentation was sent in as to how and when we <br />remedied the situations. <br />With your latest visit, you gave us a Class II violation #108, stating: <br />Failure to determine if metal fines generated from metal grinding, drilling, and cutting are being disposed of were hazardous <br />waste. <br />This is a completely different issue than that of the previously issued citations. We are in the process of determining if said <br />material is indeed hazardous and will send the proper documentation in a timely manner. However, we would like you to remove <br />the REPEAT VIOLATION mark on this new citation, as we were not previously told about the potential hazard of the metal fines of <br />metal grinding, drilling, and cutting.
