E <br />Scope <br />The Contractor (San Joaquin County) shall provide the services <br />of Douglas Wilson, Supervising Registered Environmental Health <br />Specialist, to the Commission's Division of Safety and <br />Enforcement (S&E). Mr. Wilson shall serve as an expert <br />witness for the Commission's case no. I.95-06-005 (Case No. <br />293279, The People of CA v. Rodney Ray Lawley) and shall occur <br />anytime between July 29, 1996 and June 30, 1997. Mr. Wilson shall <br />provide testimony on the search warrant effected, identification <br />of asbestos, and testing conducted for asbestos hauling by Mr. <br />Lawley. The Commission shall pay the Contractor $78.00 <br />per hour and $0.275 per mile not to exceed $999.00. <br />Contractors National Labor Relations Board Certification <br />Contractor, signing this Agreement, does swear under penalty of <br />perjury that not more than one final unappealable finding of <br />contempt of court by a Federal Court has been issued against <br />Contractor with the immediately preceding two-year period because <br />of Contractor's failure to comply with an order of a Federal <br />Court which orders Contractor to comply with an order of the <br />National Labor Relations Board (Government Code Section 14780.5). <br />Settlement of Disputes <br />In the event of a dispute, Contractor shall file a "notice of <br />dispute" with the Assistant Executive Director of the Public <br />Utilities Commission within 10 days of discovery of the problem. <br />Within 10 days the Assistant Executive Director or his designee <br />shall meet with the Contractor and Project Manager for purposes <br />of resolving the dispute. The Commission and the Contractor <br />shall agree to process an amendment to this Agreement to <br />implement the terms of the resolution. <br />Americans with Disabilities Act <br />By signing this contract, Contractor assures the State that it <br />complies with the Americans with Disability Act (ADA) of 1990 (42 <br />USC 12101 et seq) which prohibits discrimination on the basis of <br />disability, as well as, all applicable regulations and guidelines <br />issued pursuant to ADA. <br />Agreement is Complete <br />Other than as specified herein, no document or communication <br />passing between the parties hereto shall be deemed a part of this <br />Agreement. <br />Civil Rights <br />
