Failed to submit a completed Monitoring System Certification form to the local <br />agency, in violation of California Code of Regulations, title 23 section 2638(4); <br />g. Failed to record or report any unauthorized release from the underground storage <br />I tank, and any spill or overfill, in violation of California Code of Regulations, title 23 section 2650(b); <br />h. Failed to maintain written monitoring and maintenance records on-site, in violation <br />I of California Code of Regulations, title 23 section 2712(b); <br />I. Failed to identify and submit a signed statement to the local agency indicating the <br />designated underground storage tank operator for each facility, in violation of California Code of <br />Regulations, title 23 section 2715(x); <br />j. Failed to maintain a copy of the monthly inspection record and all attachments for <br />I the previous twelve months, in violation of California Code of Regulations, title 23 section 2715(e). <br />5. Defendants, in the course of Defendants' GASOLINE SALES/MINI-MART activities, are <br />Ipursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br />a. Violation of Health and Safety Code section 25100 et seq. described in <br />I paragraph 3 - 3e above. <br />b. Violation of Health and Safety Code section 25280 et seq. described in paragraph 4 <br />I - 4j above. <br />6. Defendants shall pay to Plaintiff the sum of SIX THOUSAND DOLLARS ($6,000.00), as <br />and for civil penalties, pursuant to Health and Safety Code §25299. Said payment shall be made <br />payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT - <br />ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br />Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, on or before <br />APRIL 1, 2010. <br />7. Defendants shall pay to Plaintiff the sum of SIX THOUSAND DOLLARS ($6,000.00), as <br />I and for civil penalties, pursuant to Business and Professions Code section 17206.
