UST violations HSC 25284.2 Annual spill containment testing. The owner or operator of an underground storage tank with a spill containment structure designed to prevent a release in the event of a spill or overfill while a hazardous substance is being placed in the tank shall annually test the spill containment structure to demonstrate that it is capable of containing the substance until it is detected and cleaned UP. 4 Annual spill containment testing was due by July 2005 and was not performed until November 9, 2006, 22 months late. (a) All owners and operators of an underground tank system shall maintain evidence of financial responsibility for taking corrective action and for compensating third parties for bodily injury and property damage caused by a release from the underground tank system, in accordance with regulations adopted by the board pursuant to Section 25299.3. The regulations shall include a schedule that requires that financial responsibility requirements are phased -in for all underground storage tank systems on or before October 26, 1990. (b) (b) If the owner and the operator are separate persons, either the owner or the operator shall demonstrate compliance with subdivision (a). (c) An owner may comply with this article by entering into an agreement with the operator of the tank requiring the operator to demonstrate compliance with subdivision (a). However, both the owner and the operator are in violation of subdivision (a) if evidence of financial responsibility is not established and maintained in accordance with this article. Current copies of the financial responsibility documents were not on file with this office at the time of the October 26, 2006, and November 30, 2007, routine UST inspections. Current copies were submitted on December 4, 2007. Title 23, CCR 2632 (b) Monitoring program (monitoring and response plans) is current and approved by the local agency. Owners or operators of underground storage tanks subject to this section shall implement a monitoring program approved by the local agency and specified in the underground storage tank operating permit. The program shall include interstitial space monitoring as described in subsection (c) and shall include the items listed in subsection (d). 4 Monitoring and response plans had not been submitted to this office for approval at the time of the October 30, 2006, routine UST inspection. Plans were approved and received on site by Mr. von Flue on November 9, 2006. Title 23, CCR Section 2637 Secondary containment test performed. Secondary containment systems installed prior to January 1, 2001 shall be tested by January 1, 2003 and every 36 months thereafter. 2
