UST violations <br />HSC 25284.2 Annual spill containment testing. <br />The owner or operator of an underground storage tank with a spill containment structure <br />designed to prevent a release in the event of a spill or overfill while a hazardous <br />substance is being placed in the tank shall annually test the spill containment structure to <br />demonstrate that it is capable of containing the substance until it is detected and cleaned <br />UP. <br />4 Annual spill containment testing was due by July 2005 and was not performed <br />until November 9, 2006, 22 months late. <br />HSC 25292.2 Certification of financial responsibility and CFO letter. <br />(a) All owners and operators of an underground tank system shall maintain evidence of <br />financial responsibility for taking corrective action and for compensating third parties <br />for bodily injury and property damage caused by a release from the underground tank <br />system, in accordance with regulations adopted by the board pursuant to Section <br />25299.3. The regulations shall include a schedule that requires that financial <br />responsibility requirements are phased -in for all underground storage tank systems on <br />or before October 26, 1990. <br />(b) (b) If the owner and the operator are separate persons, either the owner or the operator <br />shall demonstrate compliance with subdivision (a). <br />(c) An owner may comply with this article by entering into an agreement with the <br />operator of the tank requiring the operator to demonstrate compliance with <br />subdivision (a). However, both the owner and the operator are in violation of <br />subdivision (a) if evidence of financial responsibility is not established and <br />maintained in accordance with this article. <br />Current copies of the financial responsibility documents were not on file with this <br />office at the time of the October 26, 2006, and November 30, 2007, routine UST <br />inspections. Current copies were submitted on December 4, 2007. <br />Title 23, CCR 2632 (b) Monitoring program (monitoring and response plans) is <br />current and approved by the local agency. Owners or operators of underground <br />storage tanks subject to this section shall implement a monitoring program approved by <br />the local agency and specified in the underground storage tank operating permit. The <br />program shall include interstitial space monitoring as described in subsection (c) and <br />shall include the items listed in subsection (d). <br />4 Monitoring and response plans had not been submitted to this office for approval <br />at the time of the October 30, 2006, routine UST inspection. Plans were approved <br />and received on site by Mr. von Flue on November 9, 2006. <br />Title 23, CCR Section 2637 Secondary containment test performed. <br />Secondary containment systems installed prior to January 1, 2001 shall be tested by <br />January 1, 2003 and every 36 months thereafter. <br />2 <br />
