In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). Based on the non-compliance, your facility will not be issued a permit to operate for the 2017 year until compliance is obtained. The site must be brought into compliance to avoid your entire UST system being red tagged - 7 -days from the receipt of this Notice. A notice to abate was mailed to the facility on 5-12-2017, to date no corrections have been made to all of the violations. The outstanding violations include the following: 1) A permit to operate the UST system has not been issued due to non-compliance and unpaid permit fees. No pers may own or operate an underground storage tank unless a permit for its operation has been issued by the local agency the owner or operator of the tank (HSC 25284). 2) UST operating permit application for facility and tank information not submitted or current. The Board of Equalizati account number TK STF 44045016 is closed and not valid (CCR 2711). 3) Outstanding UDC 3/4 repair inspections (in connection with the permit SR0076414 dated 12-22-2016) were r conducted.
